Time away from the UK.
« on: August 30, 2018, 09:55:58 PM »
Hi everyone.

So my wife's spouse visa was approved at the start of August, we both made the trip to the UK and collected her BRP card about 2 weeks ago. We then spent some time there with my family. We have a few loose ends to tie up in the US that will take us until the end of the year. We then plan on making the permanent full time move to the UK late January 2019

My question is will the time away from the UK effect my wife's newly granted visa?

To follow the standard visa track of 5 years to Indefinite Leave to Remain, she needs to be a continuous resident in the UK for five years.  The visa issued from outside the UK (the one you have), is issued for 33 months to give a 3 month grace period to move.  If you extend beyond 3 months, you may find yourself having to apply for an additional visa to bridge the gap until she qualifies for ILR.
