Marrying in the US... what do we need?
« on: September 17, 2018, 05:50:23 PM »
Hello!

I'm an American citizen with a UK boyfriend. We are discussing our options for marriage and have been hearing it's easier to marry in the US, then I'll stay and apply for my Spouse Visa while he goes back to the UK.

However, I'm not finding a lot of information about what exactly is needed for the US marriage license. Since he doesn't have a social security number, what does he need to provide? And it's ok for him to get married while visiting on his passport/ESTA, correct? (We're looking at getting married in KS)

TIA!

Hello and welcome:)

My husband is British, and we got married in Louisiana in June.

Each state is different, so I would suggest calling your local Clerk of Court and getting all of the info you need.  Yes, he can come here to marry you on an ESTA as long as he has no intention of remaining in the US after you are married.

In Louisiana, where I got married, all we needed was our original certified birth certificates. Since my husband had no SS#, he signed an affidavit to that effect. But please, call your local Clerk of Court to make sure, as your state's rules may very well differ from mine. You might need additional documentation.

Best of luck!

Thank you! I'll contact them today.

And he's part of the Royal Air Force, so I don't think he'll have any trouble proving he has to return to the UK once we're married  :D

Married in Alabama and all he needed was his passport. Just check with your clerks office and they’ll tell you which Id they accept.

Definitely check locally for what you'll need.  There's no problem with him getting married to you on an ESTA, but the documentation requirements will differ depending on where you're getting married.  You might need 1-2 witnesses, or you might not need any.  He might need a single document that could be proof of ID and age, or he might need one document to prove each separately.

Back in 2010, we got married in Massachusetts, and DH needed two separate documents (1 for ID; 1 for age) and we did not need any witnesses.
