Final Step- please advise
« on: October 15, 2018, 07:43:49 PM »
Hi All,

Sorry if this has already been posted, I tried to use the search engine but feeling a little lost on locating relatable information.

I just applied for my visa and have my biometrics appointment on Thursday.

Do I need to provide a cover letter? And any example I can go off of?
Also, my husband supports me and our daughter full time, should we note that in the financial section of the application where it ask if he supports anyone?

Can you please confirm if I am missing anything or should remove anything?

Welcome to the forum :).

Okay, in terms of your documents, you don't need the following, so you can take them all out:

Sponsor’s Documents
-  Copy of birth certificate (not required)

Relationship Evidence
- Birth Certificate of child together  (not required)
  Baby passport  (not required)
Letter from sponsors parents (cannot be considered)
Passport copy of sponsors parents (completely irrelevant to application)

Additional
  school transcripts (irrelevant to application)

I would include the job contract, as they may ask for it.

You are missing:
- original, wet signature letter from the landlord giving you permission to live in the property too, as it is illegal for you to be added to the lease before you have a visa (though if you are already named on it, just send it as it is)

As you only have 5 days from the biometrics appointment to mail all your documents to UKVI, if you need to get a landlord letter, I would reschedule the biometrics for a later date, to give you enough time to receive the landlord letter from the UK.

Assuming you have no complicated circumstances (no previous refused visas for the UK, no overstaying, no criminal convictions), your cover letter should just be a contents page.

For example:

To The Entry Clearance Officer,

Please find enclosed my application and supporting documents for a settlement visa application to join my husband in the UK. I would like my visa to start on X date, as per the Intended Travel Date on my application.

The following documents are included in this package:
Yours Faithfully,

Your Name

Also, my husband supports me and our daughter full time, should we note that in the financial section of the application where it ask if he supports anyone?

You would list your child, but I don't think it includes you, because the whole point of the application is to prove he has the means to support you anyway. I think they simply mean any OTHER people apart from you.

The question guidance states:

Quote
1.28 Is your sponsor responsible for supporting anyone financially, including any children listed above?
Put a cross in the relevant box. If ‘yes’ please provide full details, including full name and date of birth for each person your sponsor is financially responsible for, and state how much is spent per person per month.

Financial Documents
- 6 months payslip April - October 2018
- 6 Bank Statements April - October 2018
- Current UK employer Letter
- Original Contract & Job Description (is it necessary to include??)
- latest P60

In regards to the payslips and bank statements, are they original?

Is the latest of each, plus the UK employer letter, dated within 28 days of applying online?

Do they cover exactly 6 months to the day?

For example, if the payslips are only dated on the last day of the month, you will need to provide 7 months of each, not 6 months, as the April payslip will only cover from April 30th onwards, and not the rest of April.

If you're even 1 day short of 6 months (and the dates printed on the payslips and bank statements must show the beginning and end date), the visa could be refused.

For example, if the latest payslip is dated, say, September 30th (for the end of the month), then you MUST include the following payslips and bank statements
March 31st
April 30th
May 31st
June 30th
July 30th
August 31st
September 30th

And the bank statements covering March 31st to September 30th (i.e. you may need the entire March bank statement too).
Thanks for the detailed clarification and cover letter example. I did make sure our bank statements were stamped and matched the pay stubs.
Can you further clarify the letter from landlord? I am getting mixed feedback and there were cases of other people who submitted a lease agreement with their spouses name added to it. Our cottage is paid for by my husbands company so the landlord added my name at time of rental, since I would visit for  2-3 month stretches, return to America for 1 month and back to the UK for 2-3 months.

If your name is already on the lease, then just submit it as is and you won't need a letter. A letter is only needed if you are not named on the tenancy, to prove you have permission from the landlord to live there once the visa has been granted.

You've done nothing wrong, but the problem is that the landlord could get into trouble and face a fine for adding you to the lease before you had a valid visa. This is the landlord's problem, though, not yours. If they have added you to the lease without checking that you have the right to rent in the UK (by way of seeing your valid visa), they could face a civil penalty of about £3,000.

It will either be a visa sticker in their passport, which looks something like this (it will state Indefinite Leave to Remain on it).

Or it will be a separate plastic BRP ID card, which looks something like this (it will state Indefinite Leave to Remain on it).

ILR hasn't been issued as a sticker in the passport since 2007 though, so if they received ILR after that, it will be a BRP card.

Since my husband is a UK citizen, does the ILR apply to him.

Do I need to print and fill this out?

Thanks again for your help!!

No, because ILR is a permanent residence visa issued to non-UK/EU citizens who have lived in the UK for 5 years on qualifying visas.

If he is a UK citizen, why do you even have the ILR page on the list? It's very rare for a sponsor to have ILR, because most sponsors are UK citizens and have a UK passport

From your list, I assumed he was not a UK citizen and was therefore providing his foreign passport and ILR visa as proof of his eligibility to sponsor you.

All you need from him is:
- a copy of the photo page of his UK passport
- his sponsor letter of support

No, you don't, because that form is for special circumstances visas only, namely elderly dependant relatives, or adult dependant relatives, where the applicant is completely physically and financially dependant on their sponsor (i.e. they cannot walk, feed or dress themselves, and they have no money of their own or means of earning money)

Your best bet is just to stick to ksand and the official guidance.  :)
