Hi! This is my first post, as I have now received some conflicting information from our lawyer and am terribly confused :) My husband is a UK citizen, having just obtained his citizenship through Form UKM (his mother is British). We're both American and plan to move to the UK in July for the first time. His current US employer has agreed to keep paying him remotely when we move to the UK. We spoke to a lawyer in June and she advised us that this will be fine and meet the financial requirements for sponsorship. Now six months later, the lawyer we are working with tells me this is incorrect and that is employer needs to be UK based. As far as I know, his employer does not have a UK presence. Everything I have read has been confusing and not very helpful. Does anyone know whether overseas income counts toward the requirement, or if he has to have an employer that is physically in the UK? Much thanks for any help.

When he moves to the UK, he won’t technically be employed by the US entitity anymore.  He will be subject to UK employment law and would need a UK employment contract.  Many do this (work remotely for a US company).  But what he will need to do is become self employed.  For example, he will now be paying tax to the UK, not the USA.  So he won’t be paid through USA payroll anymore.

So to sponsor you, he would need to meet the requirement under self employed income, which is a BEAST.

Can you guys meet the requirement through savings?  If it’s just you, it’s £62,500 required to meet the requirement.  This can be held in savings, from the sale of a home, or a fully vested 401k.

Ditch the lawyer.  Save the money and get correct advice instead.   ;)
