Discrepancies in Payslip
« on: November 04, 2018, 08:04:16 AM »
Hello,

Me (UK) and my partner (US) will be applying for the initial VISA in February of next year, and I've been  collecting documents prior to this  6 months.

I've been put in a tricky situation, where I've got to have surgery next Thursday. (The NHS put me on a waiting list but I didn't think they'd give me such short notice for the date... I was hoping it'd be next year).

I've ran out of  holiday at work, and I've been told I may need up to 2 weeks downtime after the surgery. I don't get paid company sick pay.
I understand I should get statutory sick pay.

I make £19,250  which is over the requirement, but I'm concerned that:

1. I'll have less money on my payslip, different to the others... Making my application complicated?
2. Having 2 weeks of unpaid leave will push me under the £18.6k requirement

I have a second job, which actually pushes my salary from up to 24-25k a year but I didn't want to use this on my application, as it's a 3 hour contract, but the hours actually vary considerably.

Anyone have any suggestions? If I cancel this operation, I'll have to get re-referred via the GP and it will take up to a year. If I do this operation, and I happen to be under  £18.6 then I'd have to wait another 6 months which will cause it's complications. Thanks.

According to the financial requirement guidance, any period of UNPAID sick leave will not be counted towards the 6 months of income and will be ignored... therefore they will pretend it didn’t happen and it won’t break the 6-month period.

However you’ll need to show an extra X weeks of income at the beginning of the 6 months, to make up for the X weeks missed in the middle.

So, if you take 2 weeks of unpaid sick leave, you have to be able to show that you were earning the minimum requirement for 6 months AND 2 weeks before applying for the visa.

It doesn’t mention though whether it counts as unpaid sick leave if you do get statutory sick pay, but nothing from your employer.

See page 33:

Alternatively, you could show your income from your second job, but it would mean including 6 months of payslips and an employer letter from them as well.

I don’t see that you would need to cancel or move the operation though... worst case scenario would be to include your second job income documents as well (in fact, may end up being easiest to do that anyway, then you won’t have to worry about the sick pay).

Thank you for your informative reply, and your help. This gave me a big relief that I could have an 'exception' to my payslips if being sick.

My surgery has been cancelled now, so I don't have to worry about it. Thank you though!
