If you are currently in the UK on a 33-month spousal visa, the earliest you can apply is 28 days before you reach 30 months in the UK.

So you count 30 months from the date you entered the UK, then count 28 days back from that.

You can apply any time.
You do not have to wait until your visa is about to run out or anything of sorts.
Just keep in mind that you will get 30 months this time, not 33.
So make sure with that in mind, that you will still have full 5 years FROM FIRST ENTRY as a spouse, or from the switch if you converted from fiancee visa!

You are being too literal.The op here doesn't want to know that she can apply tomorrow but then she'd have to do it all again, she wants to know when is the earliest she can apply without running out of time to apply for ILR.

So you will cover the cost of an unnecessary extra FLR(M) if the applicant applies too soon?  Applying too early would be a £2,033 mistake (after the new NHS fee is implemented in a few weeks).  Very generous of you Olga!
