Fiancé visa accepted - next steps
« on: December 09, 2018, 02:27:00 PM »
Hi all

Just had the great news that our fiancé visa has been approved and we have her passport back! However, there are no instructions as to the rules that we have to abide by moving forward over the next six months (it starts on the 13th of December and expires on 13th June, with multiple entities allowed).

Can someone tell me what we have to do next, or point me in the direction of a website explaining what we have to do?

When is your wedding planned? Basically you move, get married, and then apply for FLR(M) before the visa expires. It will be similar to the fiance visa application, but it's done in country and has slightly different documentation required. Try to make sure you have mail in both your names as quickly as possible. :)

Thanks, is there a specific timeframe that we have to get married in within that six-month period, or can we push it night through to June?

I would probably give yourself some buffer so you make sure you have the wedding certificate in hand, with the rest of the required documents. Also be aware the USC can't work (even remotely) or use the NHS bill free until their FLR(M) is approved.

As margo has said, she will need to get a valid visa application in (all requirements met) before her fiance visa expires.

Thanks for your help guys - my confusion stems from this website (https://www.migrate.org.uk/fiance-visa-uk-2018/) where it says once the visa is approved:

You will first be issued with a visa that will be valid for 30 days.

The purpose of this visa is to allow you to enter the UK.

Once you are in the UK, you will have to collect your Biometric Residence Permit (BRP) from the location you chose during the online application process within 10 days.

I’ll repeat that, just so you remember – you must collect the BRP within 10 days of you arriving in the UK.

When you arrive at the location you chose to pick up your BRP (usually a royal mail post office), you will have to show your Home Office decision letter & passport.

We have just received the passport back in the post which has a fiance visa valid in it until June, so the 30-day thing is confusing, and we've never had to do anything in terms of selecting where to pick up a BRP.

Can anyone shed some light on this?

The 30-day thing does not apply to fiance visas... so none of the information you quoted is relevant to you.

Visas are issued in different formats depending on how long they are valid for.

- Visa valid for up to 6 months (i.e. visitor visas or fiance visas) are issued as a 6-month visa sticker in your passport. You can enter the UK at any time during those 6 months.

- Visas valid for MORE THAN 6 months (i.e. spousal visas) are issued in 2 parts:
1. A 30-day visa vignette in the passport, and you must enter in those 30 days
2. A BRP card valid for the length of the visa (i.e. 33 months for spousal visas) which needs to be picked up from a UK Post Office within 10 days of arriving.

In your case, you have a 6-month fiance visa, so all you get is the passport sticker and you don't have to worry about the BRP card. Then, after you are married, your next visa (FLR(M)) will be issued as a 30-month BRP card only.
