FLR(m) time to apply?
« on: December 12, 2018, 07:42:38 AM »
My wife arrived in the UK on 11 April 2017 (spouse visa, initial leave to remain) , her BRP expires on 30 Dec 2019, when does she apply for FLR(m), whats the earliest date  we can apply and by when MUST she apply. When does the 6 months to show savings start.

FLR(m) time to apply?

My wife arrived in the UK on 11 April 2017 (spouse visa, initial leave to remain) , her BRP expires on 30 Dec 2019, when does she apply for FLR(m), whats the earliest date  we can apply and by when MUST she apply. When does the 6 months to show savings start.

The earliest date she can apply is 28 days before she reaches 30 months in the UK. The latest date she can apply is the expiry date of her current visa.

If she arrived on 11th April 2017, then she will reach 30 months on 11th October 2019. So, she can apply any time from 13th September up until 30th December 2019.

The 6 months to show savings will be determined by her FLR(M) application date. Her most recent bank statement showing savings must be dated no more than 28 days before she applies for FLR(M)... so you count back 6 months from that date to work out which 6 months of statements she needs.

For example, say you apply for FLR(M) on October 11th, and the latest bank statement showing the savings is dated September 30th... the 6 months will then be:

March 30th to September 30th 2019.

And the statements must cover every single day of those 6 months.

Thanks for that, it's just a bit odd with the 30 months but really it's 33. Anyhow I intend to apply with savings and I'll have all that in place by May, so we'll apply November making sure we have a full 6 months of statements. I just want to do it all within  the tax year so the timing works out ok.

Thanks again

The visa is issued for 33 months to give you 3 months leeway to move and establish your life in the UK when you first get it, as some people fly to the UK to pick up their BRP and then return to the US for a couple of months to tie up loose ends, or some people may not be able to enter in the given 30 days and will need to apply for a replacement visa vignette.

Since you only need to live in the UK for 60 months to qualify for ILR, that means you can potentially apply for FLR(M) 3 months and 28 days before your visa expires (depending on the date you entered the UK and whether you can prove 30 months of residency).
