Married - US & UK Tax
« on: January 21, 2019, 07:08:26 PM »
My husband is a UK citizen and I am a US citizen and we got married last January so this will be our first year filing taxes as married.
Does my husband have to do anything or notify anyone that he got married before the end of the financial year? We got married in the states.
Also since I live in the UK, what do I put on my taxes when I file them as married but my husband doesn’t live in the US?
Sorry if I’m not making complete sense, this tax stuff just is confusing to me x

I file married filing separately and only report my income. I am a us citizen  and my husband is a uk citizen. At the top of the form I list his name and under his social security number (he doesn’t have one) I list non resident alien. I have been doing this for years I don’t know what you do if you want to report your husbands income ?
My home for 18 years since June 2002. Became a citizen 2006

If your husband has no US source income it may not make sense to add him. It all depends on your situation and the credits/deductions that vary based on either filing married (and declaring his income but using the tax treaty) or married filing separately (you put NRA for his SS number). You would need to get a tax ID for him to file married, but that's well out of my wheelhouse as I use the Married filing separately choice (I probably should have gotten him a tax ID when I still lived in the US, losing deductions for student loan interest hurt).

Okay it sounds like it makes more sense to file separately.
But as for my husband’s UK tax, since we got married and got our marriage license in the US does he need to do anything or notify someone before the end of the financial year? Like in the UK how do they know he’s married?

There are generally no UK tax allowances for being married.  Your US income tax return for 2018 is due to be filed by 17 June 2019; but can easily be extended until 16 December 2019 if necessary by filing an IRS Form 4868 by 17 June - followed by writing a letter to the IRS by 15 October 2018.  An FBAR for 2018 must, however, if needed be filed with the US Treasury by 15 October 2019.
