ITIN number??

Hi guys,

Not posted on here in a while but my recent wife who moved over to Scotland to live with me last July has just filed her federal and state taxes using HR block. The software claimed she is owed a reasonable sum in tax return but we are struggling to get through the final hurdle to receive the money as I do not have a SSN.

We got a letter back from the state department of revenue wanting a SSN or ITIN, however we were told by the software helpdesk to file it and put NRA (none resident Alien) in her return next to my name as her husband instead of the SSN.

Basically my question is, do I need to get this ITIN even though I dont live there and am only her husband whos not even american, or is there another way around this?? Seems very daft as I play no part in the return i.e. none of my income was included, only mentioning me as her spouse...

Anyone had this issue before? I had hoped maybe an easy fix was supplying my NI number? Thought I would try this helpful forum as the state seem pretty unhelpful!

Is she filing as married jointly or married filing separately? For the latter you don't need an ITIN and your income as the NRA spouse wouldn't be included.

Since she only moved to the UK in July and the US return for 2018 is not due until 17 June 2019 this is quite early to file. I would ask the tax professional at H&R Block of the software folks at H&R Block.

If you get an ITIN, then your wife will have a deduction of $24,000 (MFJ), otherwise $12,000 MFS. Select the options to see the refund difference and if its worth it in your situation

If your wife does apply for an ITIN for you, you'll need to print your return and send to the IRS with W7 & supporting documents. Some H&R block offices are CAA's though, so for a fee they would authenticate passport, so you wouldn't need to send it via the mail.
