ILR Questions

Hello - I am going to apply for ILR this autumn.  I am on a spouse visa, 5 year route, but have only been on one 5 year visa (rather than two 2.5 year visas) since my husband was in the armed forces at the time of my application.  I have three questions:

1. I can't remember the exact dates, but I know my visa is dated something like 15 November 2014 (as in - you can come anytime from this date), but I didn't enter the UK until maybe 3 December 2014.  When can I apply for ILR?  I believe I count 28 days, but am not sure which date to count from, date of approval or date of entry?

2. I also want to clarify that I still need to submit the same amount of proof of address post, evenly spaced over the course of the entire 5 years?  I have been saving post from early on in my time here, just to be sure.  I've sort of divided it into even time frames (I'm sure somebody told me to do this):
Nov 2014 - August 2015
September 2015 - June 2016
July 2016 - April 2017
May 2017 - February 2018
March 2018 - December 2018
January 2019 - October 2019

I am looking to provide one letter in each of our names (or a joint piece of post) for each time frame, ideally as evenly spaced as possible.  Is that the right thing to do here? 

3. Is the P60 for each of us a necessary piece of documentation?  My husband can't find his 2019 P60 and is wondering if he needs to request one from his employer.

The earliest you can apply is 28 days prior to the date your visa vignette was stamped on your initial entry into the UK (your arrival date).

You should have an item of mail for each 4 month period of the visa.  As your visa was for 5 years, my assumption is that you would want twice the amount of mail as most.  But this is an assumption!

A P60 is optional, but recommended.  If he can get another copy, it may relax you a bit but it's not required.

It’s from date of entry so you can apply 28 days before 3rd Dec 2019.

Yes, I believe so. You need mail covering the period since your last visa was granted. For most people that will be 2.5 years but as your visa is valid 5 years, I assume you’ll need to cover the  whole 5 years.

Yes, I think so. One item in each name every 10 months. You need at least 3 different official sources.

No, P60s are not needed. They are recommended but not mandatory.

How are you meeting the financial requirement? If you can meet it using just one of your incomes, you only need to provide evidence of that person’s employment income.

Oh I hadn't thought of that!  Both my husband and I independently make more than the financial requirement per year.  I think my salary is just over £32,000.  So will I not need to provide any payslips or P60 from him at all?  I know the temptation is to just send "too much" information, but if I am assured that I don't need to send this info from him, perhaps it's better to just be concise and not overwhelm the person attending to my application.

If one of you meets the requirement on your own, then they only need to see one set of income documents. So you just decide whose income you are going to use and then leave the other person’s employment details blank on the form.

You’ll need payslips, bank statements and an employer letter, plus the optional but recommended documents are the job contract and P60.

Thanks for your reply.  Someone else who has replied below has said an item of mail for each 10 month period (which seems to be what I had calculated already, so someone must've told me that 10 month figure before).  Where does the 4 month number come from?  Every 4 months over 5 years is a lot, I've been saving some but not totally sure I have quite that much, but let's hope so.

Honestly, I don’t know if it should be 10 months or 4 or 5 months.

The instructions say 6 items spread evenly over the period since your last grant of leave.

Normally, this will be 6 documents over 30 months, so 1 every 5 months (or 6 document over 24 months for FLR(M), which is 1 every 4 months).

But your visa is valid 60 months, so 6 documents over 60 months is one every 10 months

I don’t think we’ve seen anyone else apply with a 5-year visa yet, so I don’t know if you should just include them every 5 months or 10 months.

Fair enough!  Thanks for explaining the thought process anyway.  I will make sure to do the bare minimum of two items (addressed to us separately) every 10 months, but will probably through in a few extras evenly spaced throughout just to cover all my bases.

As I said, it's an assumption.  I would personally send for every 4-5 months as required for non-armed forces applications, but I do not know for certain this is required.
