FLR (M) Help - Fiance to Spouse

Hey Everyone! This is my first post on the forum. I am in the UK currently on a fiance visa and currently applying for FLR (M). While I managed the first visa successfully on my own, I am feeling a bit overwhelmed with this application and thought I would seek some advice. I have a few questions on the online application that are worrying me. Some of the questions seem silly to clarify, but I just do not want to mess anything up  ???

For a little about my specific circumstances, my husband and I have no dependents. He has been with the same employer (salaried position) for almost four years now and has continuously made over the required salary. We applied Category A  for our fiance visa in the States, and will apply Category A again.

First Question -- What type of residence permit or visa do you have?
I wrote "D-Marriage/CP Standard" as this is what is printed on my entry clearance sticker -- is that correct?

What type of visa, leave to enter or remain or other permission do you have to be in the UK?
Should I chose a 'family' visa or 'settlement'? The wording is confusing for this one since it list both options

Have you lived with your partner continuously for 2 years?
I could not since I have only had a fiance visa for a couple months. Do I just say no and explain that?

Last question is my biggest concern -- As I said, we applied Cat A to get here. My husband receives a salary increase annually every April, which means that half our pay slips list his old salary and  half list his new salary - both well above the 18,600 annual. His employer stated the annual pay increase and the time he earned both salaries in their employment letter. However, we hit this question What do they earn? The same amount continuously, above the financial requirement amount or Not he same amount continuously, above the financial requirement amount

Now if I pick not the same amount, it seems to switch me to Category B and ask for 12 months payslips. My husband and I are interpreting the question differently. He is reading it as are you salaried or hourly/fluctuating monthly pay, I am reading it simply as have you ever had a pay change in the last six months

Don’t be overwhelmed :). You’ve done the hard part already by applying for the fiancé visa. The FLR(M) is basically the same application documents again but with your marriage certificate and including some mail addressed to you both for the relationship requirement :).

You can write that, or you can write something like: ‘a settlement visa for the purpose of marriage in the UK’

We’re not sure on this ourselves - I think people have been ticking ‘family’.

Yes.

You say No and explain that you have only just arrived in the UK.

Remember, that this is the same form you will complete again in 2.5 years, so it is set up to cater for those people as well - not all the questions will strictly apply to everyone.

It’s a badly-designed form that doesn’t make sense.

As Category A, you ONLY need to provide 6 months of payslips, but the form doesn’t seem to know this and likes to insist on 12 months when you only need 6 months.

I guess your options are:
- tick the first one, and interpret it as that you have earned ABOVE £18,600 continuously for the 6 months
Or
- tick the second one, ignore the 12 months part and only send 6 months of payslips and bank statements

Thank you so much! Sometimes I feel like this system was put in place to be as absolutely vague as possible. I have a Master's Degree and cannot even decipher some of their  application questions. I have never had a process make me feel less intelligent.

I have another question because I have seen conflicting information on this...
Please enter the country you have lived in. You will be able to enter additional countries after you click save and continue. Include all countries no matter how long you lived there.
Obviously I will list the USA, but I've seen people claiming this is actually meant to be travel history and I should list every time I entered/exited another country on holiday. I know we did that during the initial fiance visa, but this question is specifically saying "country you have lived in" -- Am I interpreting this wrong? Is there another place on the application I should be entering my travel history like I did with the initial visa?

No, that’s not true. You cannot legally live in a country as a visitor, so this is NOT asking for your travel history.

It is asking which countries you have legally lived in, either because you are a citizen of that country or you have held a residential visa for that country (like a student, work, fiancé or spousal visa).

If you only ever lived in the US previously and you now live in the UK on a fiancé visa, you only list the US and the UK.

You're not the first person to say that recently! Don't worry, it's not you, it's them.  :) The paper forms were not the best but they were a whole lot better than this awful online thing that they've cobbled together!

Thank you both!

I have only lived in the US as a citizen and UK as a student before this visa. I included both of those. I am glad to see that I wasn't missing something completely.

We had everything ready to submit tonight and then the application just threw me through a loop that had me wondering if I was ready. I feel much more prepared again with your help  :)

I HOPE this will be the last question. I am uploading my documents for FLR. Do I need to submit copies of every page of my passport or just the bio page/pages with stamps? Thank you in advance.

No, no extra clarifications to what I posted above.

For the first question, you can either put what's on your visa, which is: D-Marriage/CP Standard, or you can put something like 'a settlement visa for the purpose of marriage in the UK'.

For the second question, I guess you can put either family or settlement - we really don't know which you're supposed to put because 'family' and 'settlement' visas are the same thing, so there should not be 2 different options.

If other people have put family, then maybe put family?

As noted in another post, I called the UKVI helpline (https://www.gov.uk/contact-ukvi-inside-outside-uk/y/inside-the-uk/general-immigration-enquiries) to get clarification on this question of Visa Type. Their response was to hire an immigration lawyer!  >:(

Can't believe UKVI helpline can't even tell us which is the correct option to tick. Should be a simple and straightforward question.
