Hello I'm new to the forum but have been following it for a while! Thanks for having me
To keep things short and simple I'll let you know the situation and then will deliver the questions.
I plan on moving to the UK and doing the spousal visa. Initially we thought wes do the fiance and then the spousal but it's a) expensive and b) Id be a sitting duck without a job
If I'm correct and this forum has guided me correctly, it appears to be legal for him and I to marry in the US on an ESTA while he visits me. This is for two weeks and then he'll go back because he has a Job and a life to live. After getting married here we will then wait until January which is for him, the sponsorer, the required amount of time (6 months) in order to prove work and Financials.
Additionally we didn't plan on applying for his visa stuff on the US side because we don't plan on living there until after 5 years or so. My concern is however if a spousal visa is required for him were we to visit my family.
My questions are -
1. Am I correct in the legality of him coming here, marrying and leaving?
2. Does he have to apply for a US spousal visa within an allocated time even if we are living in the UK?
3. If not, when I visit home in the US and bring him with me will that be an issue with border officers? Does an ESTA still work for him? Or as my spouse will he need a spousal visa to get in?
