FLR (M) tricky question help!
« on: October 08, 2019, 10:13:09 PM »
Hi everyone I am doing my 2nd FLRM and I'm stuck on this! would i say yes or no?

Is this the first time you have applied for a partner route, or an extension, with your current partner (including as a fiancé(e) or proposed civil partner)? Is this the first time you have applied for a partner route, or an extension, with your current partner (including as a fiancé(e) or proposed civil partner)?

the next question is even harder what would i choose for flrm?
Please choose the reason you are applying for an extension, this includes if you are switching to a partner visa from another type. (Required)

First extension as a partner (following an initial period of entry as a partner, or as a fiancé(e) or proposed civil partner of a settled person)

Additional extension as a partner

First application as a partner from within the UK (for example, you are currently in the UK on another type of visa or permission to stay)

You delayed your travel to the UK by more than 3 months after the issue of a visa and have not yet completed the required amount of time on a partner visa (not including as a fiancé(e) or proposed civil partner)

You require more time to meet the Knowledge of Language and Life in the UK requirements to apply for settlement

You were granted entry as a fiancé(e) or proposed civil partner, but have not yet married or entered into a civil partnership

You are applying for any other reason

last question the flrm is considered a family or settlement visa? thanks!

On which route did you enter the UK initially? As a spouse with leave for 2.5 years or a fiancé visa for six months? Or were you in the UK on a different visa?

- For the first question, answer is NO, because this is the THIRD time you have applied for a partner visa. The first was the fiance visa, the second was FLR(M) and now this is the third.

- For the second question, you tick 'additional extension as a partner'. FLR(M) is an extension visa, so the first extension was when you switched from fiance visa to FLR(M) and so now this is your second extension.

Technically it's both, because family visas ARE settlement visas - they are the same thing. I think most people have gone with family visa, but ultimately, I don't think it really matters which one you select.

On which route did you enter the UK initially? As a spouse with leave for 2.5 years or a fiancé visa for six months? Or were you in the UK on a different visa?

Regarding this question " Is this the first time you have applied for a partner route, or an extension, with your current partner (including as a fiancé(e) or proposed civil partner)?"

Would my answer differ?

I applied for the initial fianceé visa that gave me permission to enter the UK to get married for what I believe was six months (9/15 - 3/16). We got married and then I went back to the US and applied for my spousal visa from there (exact timeline in bio below).

I'm thinking I'd answer yes, because this is the first time I've applied for an extension.

So you came over on a fiancee visitor visa, not a settlement path fiancee visa?  Then you got married, went back to the US before the visitor visa expired, and later returned on a spousal visa?

If that's correct, this is your first extension.
9/1/2013 - "fiancée" (marriage) visa issued
4/6/2013 - married (certificate issued same-day)
5/6/2013 - FLR(M)#1 in person -- approved!
8/1/2016 - FLR(M)#2 by post -- approved!
8/5/2018 - ILR in person -- approved!
22/11/2018 - Citizenship (online, with NDRS+JCAP) -- approved!
14/12/2018 - I became a British citizen.  :)

Yes, that’s right. Sorry I wasn’t clear but thanks for clarifying that it’s a yes  :)

Yeah, you've never actually held a fiance visa, because those cost £1500 and you don't have to leave the UK after the wedding.

What you applied for back then was a Marriage Visitor Visa, which is just a visitor visa that allows you to marry and then leave the UK (like a destination wedding), whereas a fiance visa allows you to live in the UK after the wedding.

So, what you've applied for/are applying for is:
- visitor visa (to marry in the UK then go back to live in the US)
- spousal visa (first partner visa)
- FLR(M) (second partner visa/first extension)
