Flr(m) and benefits
« on: October 12, 2019, 11:43:01 PM »
I have 2 years until my renewal but I just wanted to ease my worrying a bit. My husband got laid off and is now receiving universal credit (which in our area is instead of job seekers allowance). They made me list myself but It says I’m not eligible for funds obviously.

Will this hurt my next application for flr(m) that my husband got benefits during this time? Does it ask about us getting benefits at any time on the application?

For clarification my husband is a British citizen invade that’s relevant :)
Thanks!

If all he was asking for was Job Seeker's Allowance and he has been working in the UK for the previous 2 tax years, then why didn't he claim Contribution Based JSA benefit, now called New Style Jobseeker's Allowance? That way your earnings and any savings/capital you both have would not be used for his benefit calulation. Contribution based benefits are not public funds.

I am not sure. I think he was also looking to get child  tax credit too?

The Tax Credit benefits have ended and are two of the low income benefits have been replaced by Universal Credit. New claimants apply for Universal Credt and all exisiting claimants of working age (below age 67 at the moment) will have their benefits stopped in due course and will have to apply for Universal Credit

On UC, he can't claim extra low income benefits for a foreign spouse anymore as happened with the Working Tax Credit benefit because no recourse to public funds is now the same for all visa holders.

Your income/saving/capital will form part of his low income claim but I don't know how this will affect your status as Universal Credit is nothing like the 6 benefits it replaces. You could visit your local CAB and ask if they know or you can play with the benefits calultators and see what they say about somebody who has limited leave to remain.

If you are working Shivi, you can also use your income towards the requirements this time. Just be sure you are following the requirements and not claiming any benefits for yourself and be familiar with the adequate maintenance calculations if you aren't working or don't meet the minimum on your salary. I hope he isn't unemployed for an extended period of time, I know how difficult that can be without the added stress of visa planning!
