ILR and self employment verification
« on: January 01, 2020, 03:56:36 PM »
Hiya-
In the middle of gathering all my paperwork for my ILR visa and I need to send information about my husband’s employment. I’m supposed to have a letter from his employer except he’s self employed. How do I go about doing this?
Thank you for any help.

Ah, self-employment is a whole different category and is tricky to get right. If there’s any way you can meet the financial requirement without using his income (I.e. if you are employed and earn at least £18,600 per year, or you have £62,500 in savings), that would be preferable over using self-employment, and in that case you just leave his employment details blank as if he does not work.

There are about 14 different documents he must provide for self-employment income and only the last full financial year of income can be used (for Cat F) or the last 2 full financial years (for Cat G).

Assuming his tax year is April to April, you will only be able to use income that he earned between April 6th 2018 and April 5th 2019 for Category F (or April 6th 2017 and April 5th 2019 for Cat G).

He needs to show that he earned a total of £18,600 between April 2018 and April 2019, before tax but after expenses, and he must provide things like HMRC registration documents, annual tax returns, invoices, bank statements, accounting documents, etc.

See page 60 onwards of Appendix FM 1.7 for how to qualify using Self-Employment income:
https://assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/826340/Appendix-FM-1-7-Financial-Requirement-ext_1.pdf

And see pages 64-65 for the list of all the documents he needs to provide for self-employment income

Just taking a quick look at your previous posts, I see you arrived in the UK on a spousal visa in 2017?

In that case, you should be applying for a 2.5-year FLR(M) visa now, not ILR. It takes 5 years to qualify for ILR, so your visa journey is:

- 2.5 years on a Spousal visa (2017-2020)
- 2.5 years on FLR(M) (2020-2022)
- ILR after 5 years in the U.K. (2022)

The FLR(M) visa costs £1,033 plus £1,000 IHS surcharge.
