FLR(m) mark 2 questions and checklist

Hi all

We’ve practically completed the online form and put together our evidence, we’re just waiting for a few last bits to come through. Hoping to submit everything at the beginning of next week.

Going through the application we had a few questions about some of the questions and were hoping you could share some wisdom!

What type of visa, leave to enter or remain or other permission do you have to be in the uk? We’ve selected family here - but should that be settlement?

For trips where we’ve left and returned to the UK on the same day, do we need to declare them? It comes up with an error when we’ve tried to enter them so I’m assuming not.

Employment (I’m afraid there are a fair few questions here):

I (the sponsor) have been employed by the same company for over 5 years now and have held 3 different roles. Each of which has had a separate contract. I started my current role on 15 July 2019.

For the question:
-when did the current employment begin? do I put the date I started working for the company, or the date I started my current role?

- annual income? Do I put my current wage, or the wage I was earning in my previous role (which was put on my July payslip)?

- what do they earn? My income in both roles didn’t vary month to month as I’m a salaried employee (other than when my role changed, so my July payslip is different to the subsequent ones) - do I say that I was earning the same continuously above the requirement, or not the same continuously above the requirement?

When it asks about the living arrangements you have it gives the options, I own the property, I rent the property or I have a different arrangement. In our case I (the sponsor) own the property - but to me the question is framed about whether the applicant owns (which he doesn’t). In anyone else’s experience do you know if they mean the applicant or the sponsor own - or whether we should say it’s a different arrangement?

To our checklist of items:

- Applicant passport (all pages)
- Applicant BRP
- Sponsor passport (all pages)

-Marriage Certificate

Correspondence
April 2018 - applicant bank statement & sponsor credit card statement
August 2018 - applicant credit card statement & sponsor credit card statement
January 2019 - joint water bill
May 2019 - applicant bank statement & sponsor credit card statement
September 2019 - applicant credit card statement & sponsor savings account letter
January 2020 - joint gas & electric bill

Sponsor is meeting the financial requirement:

- July 2019-January 2020 payslips (stamped and accompanied by a letter from payroll confirming their authenticity)

- most recent P60

- sponsor bank statements July 2019-January 2020 corresponding to the payslips

- letter from employer confirming length of sponsors employment, salary, type and length of employment. Here I’ve also asked them to explain my change in role. However, they’ve said that before they’ll issue the letter they need to have an address to direct it to - has anyone else has this, and what address did you tell your work to use?

- the contracts for all three roles I’ve had at the organisation since I started working there

Accommodation:

- copy of the land registry documents for the sponsors property

- most recent council tax bill for the property

- most recent mortgage statement for the property

Any insight you can provide would be gratefully received!

This question is confusing on the form because a family visa IS a settlement visa... they are the same thing! So I have no idea why they have both options.

I think most people have ticked ‘Family’.

Technically, I think you should declare them because you left the U.K., but if it won’t accept the dates, then you can’t enter them.

I think what I would do is include a note in a cover letter and a list of those trips on a separate sheet of paper.

Date you started working for the company 5 years ago.

Current wage.

If you are salaried, they will use your lowest payslip to calculate the income requirement, so if one of the payslips has the old pay on it, they will use your old salary... but your current and future earnings will be the new wage (and the employer letter will state your new, current wage and the date you started earning it)

Same amount continuously above the requirement... if you don’t put this, the form will tell you to provide 12 months of payslips and bank statements, but that’s incorrect.

It’s about you collectively as a couple. They want to know if the house is owned by one of you, rented by both of you, or neither (I.e. you live with family or friends who own the house).

So you tick ‘I own the property’.

The application does not get sent anywhere because you upload the documents now, so I’m not sure if there is even an address they can put.

Maybe Sheffield? Though that’s where the initial spousal visa is processed.

Contracts are optional so you don’t need to include these.

If you do want to send a contract. you only need the most recent one for your current role.

Thank you! I’ve got to the point where I’m doubting my instincts on what to put so thought it was best to ask!

For the accommodation questions, when I say I own the property it asks how much the mortgage is. Since I am solely responsible for the mortgage and not the applicant, should we put £0? Or the amount of the mortgage?

Put the amount of the mortgage, not zero.

You put the amount of the mortgage (like it asks for). If you put £0, then it looks like you don't have a mortgage at all.

Remember, these questions are trying to determine whether you meet the accommodation requirement or not (that you somewhere to live that you or your sponsor owns and that you/your sponsor are maintaining payments for that house), to make sure you won't end up living on the streets and needing government assistance after the visa has been granted. 

They are not asking whether you personally own the house, or how much you pay for it as an individual, they want to know about the property you and your sponsor own and live in as a couple, and what you pay for your housing costs as a couple.
