Various ILR Questions

Good Morning All

I am going to be applying for ILR at the end of the month/beginning of October and I have some questions. I feel very unprepared this time around applying as we have a nearly 4 month old baby and have just been completely imersed in being new parents. From what I understand, the application is done online completely, the supporting docs are scanned in and due to covid I think the biometrics are now being done via an app? Is this correct? As far as supporting docs go, is it very similar to FLR(m)? I have the list of my previous docs submitted for the last visa. Can someone advise what else is needed or can be omitted from the list below?

With the docs being scanned in, is it necessary for them all to be 'originals'? Meaning if we have online electric bills, can these just be printed from home and submitted as is? Most of our other docs are posted to us but I am a bit concerned we wont have enough cohabitation docs that are 'original'. How does this work for the bank statment portion? Do these still need to be stamped and signed by the bank as well? What about passports? If everything is being scanned, I am assuming that the passports do not need to be posted?

I am going to be starting the online application tonight and just doing bits of it in the evenings once baby has gone to sleep. Any help on the above would be very much appreciated.

Here is the list of docs I previously submitted. I know that I need to cover cohabitation docs from the last 2.5 years and I am assuming this is around 6 documents again? I also know we do not need to pay the IHS surcharge this time around. I also have the Life the UK test pass number.

You pretty much have it all correct.
No IHS, you do need the life in the UK test pass, correspondence over 2.5 years, as you mention.
The requirements for original documents are the same as before. Online bank statements must be stamped on every page or accompanied by a letter of authenticity and correspondence doesn't count unless it's been posted to you through the mail.

Going through the checklist and just wanted to double check on a few things.

- For the covering letter, what should I include in this?

- I have read elsewhere that passport photos for husband and I are not needed for this visa? Is this correct?

- Does my husband need to type up a sponsor letter? If so, what should be included in this letter?

- For accommodation, we moved into a rented house in Jan of this year. Prior to that we lived in another rented property, do I need to provide tenancy agreements for both? Or just where we currently live?

- Do we need to submit any photos of ourselves together? Assuming no, but just want to double check :)

- We recently had a baby, should I include a copy of her birth certificate showing she was born in the UK so she isn't considered a dependent?

You don't need a covering letter unless you have something complicated about the application that needs to be explained.

That's correct, no passport photos are needed

No, he doesn't - no sponsor letter needed for in-country applications.

Only where you currently live (unless you're using the old one for your correspondence documents).

You need the tenancy agreement and latest council tax bill

No, photos are not needed for FLR or ILR.

- birth certificate
- passport
- letter dated in the last 3 months confirming their address (i.e. from their GP)

Not sure I have a letter dated within 3 months for the baby. I only had one letter come from the GP and that was around June. She also does not have a passport as of yet, mostly due to Covid to be honest. We only have a birth certificate. Should I attach a letter stating this?

Yes, you would only need to include the old tenancy agreement if it will be used for one of your 6 documents showing cohabitation over the last 2.5 years.

Okay, you will need to get a new letter from your GP, then, as the letter is a requirement - even though the online application document list doesn't actually ask for it, we had someone a few months ago who did not include a letter confirming their child's address, and UKVI had to contact her after she applied to ask her to send it... which then likely delayed the application processing time while she got a letter sorted out and sent to them.

Wow, can’t believe nowhere in the required docs does it mention this. With regards to my child, the only question on the app was ‘do you and your partner have any children’ to which I answered yes. There was nothing else mentioned about passport, letter, even birth certificate.

So the GP letter only needs to state that she lives at our address? Anything else? With the way things are right now with Covid, it’s hard enough to get through let alone a letter. Nightmare.

Yes, it just needs to confirm her address (I.e. confirm the address they have on file for her). The GP may charge you for the letter - I’ve seen about £25 mentioned by others in the past.

Okay. I’ll ring them tomorrow to see what they can do. Is it possible to just have her surgery registration letter resent out to me with a more current date? I mean my daughter is 4 months old. She doesn’t have very much documentation as of yet. Or should I just specifically say that I need a letter confirming the address they have on file for her. Sorry, just don’t want to mess this up!

You just need something with her address on it... either a letter addressed to her sent to her address, or a letter addressed to you, confirming her address in the letter.

So, basically, you just need whatever you can get from the surgery.

If they will re-send her registration letter to you, that’s great. If not, you’ll have to ask specifically for them to create a letter that confirms her address (which you may have to pay for).

I haven’t really seen anyone say they’ve been able to get a registration letter re-sent, so I’m not sure if that’s something the GP can/will do.

It's for ALL children that the sponsor and applicant have together, or any children either of them have from a previous relationship. If the child is from a previous relationship and lives with their other parent, you also need to provide evidence from that parent as well.

From the old paper FLR(M) form (Version 07/2018):

You must provide an original full birth certificate i.e. one which shows the parents’ names for all your children. This includes children applying for leave to remain in the UK with you, those applying separately as a child of a person with limited leave as a partner of a settled person in the UK or person who is in the UK with refugee leave or humanitarian protection, as well as children not applying with you and those not subject to immigration control.

If you are applying as the child of a person with limited leave as a partner of a settled person in the UK or person who is in the UK with refugee leave or humanitarian protection and you are under the age of 18 (or children who are over 18 and who have already been granted leave in this category) then you must provide the documents listed below, in addition to those already
listed above:
• Evidence of where you normally live.
• Evidence that your parent plays an active role in your upbringing. This evidence should be dated within the last 3 months and can include:
▪▪Official correspondence addressed to the child;
▪▪Doctor’s/hospital letters on official headed paper stating the child’s registered address;
▪▪School/nursery letter(s) on headed paper stating the child’s registered address.

If you have dependent children under the age of 18 in the UK (or children who are over 18 and who have already been granted leave in this category as your dependent), you must provide the documents listed below for each child, in addition to those already listed above, even if they are not included in the application:
• Passports/travel documents to confirm your child’s immigration, settlement or citizenship status.
• Biometric residence permit if your child has been issued with one since entering the UK. FLR
