FLRM Extension - Applying Query

Hi, I was wondering if some of you can help clarify when I can apply or my FLR(M) Visa Extension.

Below is a recap of my time in the UK

-September 2016 Entered UK on Tier 4 Student Visa (Issued 15-09-2016 and valid to 03-02-2018)

- FLRM Visa Applied for 02-02-2018  (granted 29-05-2018 and valid to 30-11-2020)

I am now looking to apply for FLR(M) extension. I get confused as to whether it is 30 months or 28 days prior to current visa expiring.

Could anyone offer some insight into this?

In this because your visa is valid for 30 months, it's 28 days before the end of the visa, up until the expiration date.

Yes, that's correct.

The reason it's a bit confusing is because it depends what visa you entered the UK on as to when your 5-year count to ILR starts.

If you entered on a Tier 4 and switched to FLR(M), then your 5-year count starts on the date your FLR(M) started... and therefore you reach 30 months on FLR(M) on the expiry date of your visa... and you can apply 28 days before this.

But if you had married before moving to the UK and applied for a 33-month spousal visa, your 5-year count would have started on the day you arrived in the UK, so you can apply 28 days before you reach 30 months... which could be up to 4 months before the spousal visa expires, because the visa is valid for 33 months, not 30 months.
