FLR (M) extension - document list and questions
« on: October 21, 2020, 11:15:00 AM »
I've completed the majority of the online form and before submitting, want to check that my document list will suffice.

To provide some context, my husband (the applicant) does not currently work, and we live with a parent while saving for a house. That means he has very limited mail for him and I don't think I can quite fit all of the months but I have the below which I think will be ok. Can someone clarify please?

Mandatory Documents

Applicant Passport
Applicant BRP card
Spouse UK Passport
IHS Receipt (is this still required, we did for initial spouse visa?)

Financial documents

7 months of payslips - to ensure full 6 months is covered
7 months of bank statements showing salary being paid in
Letter of employment
Job Contract
P60 - 2019/2020

Accommodation documents

Letter from homeowner confirming we can live here
ID of homeowner
Mortgage statement for homeowner (Dated April 2020)
Council Tax Bill (April 2020)

Relationship documents

Marriage certificate
Cohabition confirmation letter from relative we lived with
Cohabitation Mail:

October 2018
Me: Monzo - Personal Account
Husband: Monzo - Personal Account

March 2019
Me: Monzo - Joint Account
Husband: Monzo - Joint Account

August 2019
Me: Monzo - Joint Account
Husband: Monzo - Joint Account

January 2020
Me: TSB - Personal Statement
Husband: DVLA

June 2020
Me: Loan Guarantor letter for a relative's loan (UK Credit)
Husband: NHS Letter (Dated May 29 2020)

October 2020
Me: Monzo - Joint Account
Husband: Monzo - Joint Account

Consent
All three consent forms signed (applicant, spouse and third party [homeowner])

Finally, am I correct in saying that after submitting I have 28 days to submit all documents?
What's the current situation with appointments - do we still go to the application centre (our closest is Glasgow I think)?
If I can't get an appointment within the 28 days, is the application just cancelled?

Thanks for any help in advance, this forum was invaluable to be in getting my first spouse visa approved for my husband.

You need the land registry document of the homeowner.
Are all your items of correspondence original hard copies which arrived through the post?
The spacing could be better, you should be looking at every 4 months, it's easier if you give them 7 joint equivalent items.

I've just checked on Scotland's Land Registry site (https://scotlis.ros.gov.uk/search) and our home doesn't show up. Every other house on the street seems to be there but I can't order for my house. Is this 100% needed or just supplemental to the mortgage statement? If so, I'm not sure how I will get this.

All items are hard copied received by mail. We order the Monzo ones to ensure we have them.

I think if I change the months I will really struggle to get enough items as his mail is so sparse. Will the current docs suffice given that they say 6 items evenly over 2 years?

I've just submitted a request on the land registry site for them to search and see if they have the property on their old register. It would still be good to know if this is 100% needed in case they don't find it. My aim was to submit the application online before 27th October.

That can be the case if the house has not changed hands in a very long time but I would call them to see what they say just in case it is an oversight and they can get the listing for you manually. If you can't get the land registry you should include whatever relevant paperwork you can from the purchase of the house.

Good about the mail being original, I wasn't sure if an online bank would send originals.

It should be fine.

Thanks for all of the advice. The house was last purchased in 1997 so that could expain it. Hopefully my request will dig something up.

Sorry to jump in here with a question.

Can you not just print out the electronic statements from the respective bank?

The ones I have are downloaded from HSBC and are exact copies of the ones we would get in the mail. They are fairly official including all details, bank details and their logo + branding.

Thanks!

My understanding is everything should have been via mail but I don't know how they would know the difference if it looks exactly the same. Maybe someone with more experience will be able to help here for you.

I'm hoping someone might still be able to help me understand what things look like once we hit submit just now.

For the financial requirement, if the statements are printed from online banking, they MUST either be:
- stamped by the bank on every single page
Or
- accompanied by a letter from the bank confirming their authenticity

This is to confirm that you did not forge, alter or tamper with the amounts on the statements before you printed them.

For the cohabitation requirement, ALL documents MUST have been received in the post in the months they are dated, because you are proving that you were both living in the house in those months and therefore were physically present to be able to receive them in person.

You cannot use any electronic documents for the cohabitation requirement because they do not prove you were actually living in the house on the dates they were issued. For example I have a US bank account registered to my aunt’s address in the US... I receive electronic statements every month... but I cannot use them to prove I live at her address in the US, because I don’t. I’m British and haven’t lived in the US in 12 years.

Another question I'm.hoping someone can clarify

For shared financial responsibilities, I've put no. As my husband does not work, all financial responsibility is mine. Is this the correct thing to say? Would this go against us? Or should I maybe explain somewhere that him not working is why this is.

That would only be the case  if you literally have no bills or tenancy agreement or mortgage or credit cards or current accounts of any kind in joint names.  Just because you pay for everything doesn't mean he has no responsibility for it.
If you actually do have nothing in joint names then the answer will be no. It won't go against you but it is unusual so I would explain it.

Ah ok, so having a joint current account is enough?

We don't rent because we're living with a parent while saving for a house so the only financial thing linked to me is the joint account we share.

I would argue that it is as the responsibility with a current account is for the holder(s) not to overdraw/exceed their arranged overdraft. That's why there is a credit check when you apply for one.
However if you don't think this applies, then you can write no and explain. It's not going to make a difference to the outcome of the application.  :)
