FLR (m) CLARIFICATION
« on: October 27, 2020, 09:20:08 AM »
Hello all,

a few  things I'd like to clarify if I may ...
I just moved ...do I have to inform UKVI of my change of address?

Does just the tenancy agreement satisfy the accommodation requirements or do I need something stating it is adequate for occupancy?

My BRP expires on 22 September 2022.  I'd like to wait as long as possible to apply for the FLR (m) to not have issues with the 5 year ILR.
Do you think applying around the 1st of September is adequate?
If so, what are the dates of the spacing for my proof of living together?

Many thanks in advance for any advise given.  This forum is a gift from above !!
hope all are stay safe xx

Yes, you do - they need to have a record of your up-to-date personal details.

You just need to fill out a form:

You need:
- tenancy agreement in both names
- if the tenancy is not in both names, you also need a letter from the landlord confirming that the other person still has permission to live there
- your latest council tax bill

What date did you enter the UK? I see that your visa was approved in early December 2019, so I assumed that means you arrived in the UK sometime in December 2019?

You can apply for FLR(M) up to 28 days before you reach 30 months in the UK. If you arrived in the UK in December 2019, you will reach 30 months in June 2022. Therefore you can apply for FLR(M) any time between May 2022 (28 days before the date in June you reach 30 months) and September 22nd 2022.

Personally, I don't think there's much need to wait to apply, but it's up to you and when you feel comfortable applying.

If you want to apply in May or June 2022, then go for it. If you want to wait until September 2022, that's fine too.

The 5 years for ILR is only really an issue if you apply 28 days before you reach 30 months AND use the 24-hour priority service. However, if you don't use the 24-hour priority service the 5 years for ILR isn't so much of an issue anyway because your visa can take 8 weeks to be issued and you can choose to schedule your biometrics for a few weeks out, which buys you a couple more months towards ILR anyway.

They need to be spaced every 4 months covering the final 2 years before you apply.

So, if you were to apply on 1st September 2022, you would need mail from:
August 2020
December 2020
April 2021
August 2021
December 2021
April 2022
August 2022

But if you decided to apply in June 2022, you would use the following months instead:
June 2020
Oct 2020
Feb 2021
June 2021
Oct 2021
Feb 2022
June 2022

And similar for applying in July or August 2022 - you just adjust the months you need to fit with the month you apply.

thank you for the info.

I arrived in the U.K. on the 30th of December.  When would you suggest I apply for the FLR (m) in your opinion?

for the proof of relationship residence, I only need 3 different kinds of documents in both of our names if I remember correctly.

You can apply on any date between 2nd June and 22nd September 2022.

It’s completely up to you when between those two dates you apply... I can’t really advise on when is best for you because that will depend on your personal circumstances.

For example, you may find the specific months that you have correspondence for mean you are better suited to apply in a particular month. Or maybe you have a trip planned for that summer and you want to wait to apply until after you return.

The only thing I would say is that if you plan to use the 24-hour Super Priority Service (which is not currently available due to Covid), to apply a bit later rather than sooner.

You need:
- 1 document in each name dated every 4 months, giving 6 documents in each name... that could be 6 joint, 12 separate (6 each) or a combination of both
- you need at least 3 different official sources
- if they are individually addressed they need to be from the same month as each other, preferably dated as close to each other as possible
