ILR (SET M) NO PAYSLIPS

Hi all,

I'd really appreciate some help with an issue regarding payslips.
My husband will be applying for ILR soon, he has been in his current employment for 2 months, prior to this he was working with a company for 5 years.
Now the issue is that since he started his new job he has not received any payslips. He has queried this with his boss who has told him that the company is yet to pay tax yet (its a new company) and they are waiting for some kind of confirmation from HMRC to start paying tax.
However this is of no help to us, I believe that my husband MUST submit payslips for his new employment but he is unable to obtain these.
Can someone please advise on this? Will a letter from his employer explaining the situation be sufficient?

I will outline some other info below so it doesn't have to be asked again and hopefully someone can help as panic is starting to set in.

1. With the previous employment my husband my husband was earning over the required threshold and he is also earning above in his current employment.
2. He will be submitting 12 months worth of payslips for previous employment.
3. His bank statement shows the new salary he is receiving.
4. His new employer has provided him with something the company accountant sent, which shows the ampunt my husband has been paid since he joined the company 2 months ago as well as tax paid.

I would highly appreciate help with this please.

If he has not received any payslips from the new job yet, then he cannot provide any payslips from it... and it's not his fault that he hasn't received and yet. So, I don't think this anything to worry about, as it's his employer's issue to explain, not his.

So, his employer needs to explain why they have not issued any payslips yet in their mandatory employer letter and confirm any payments he has already received from them, including all the details (pay date, gross pay, net pay, date paid into his bank account etc.).

Your husband will also need to include:
- all payslips from the last 12 months from his previous employment (i.e. from the 10 months prior to starting the new job)... if they are electronic, he also needs a letter from the old employer confirming their authenticity
- 12 months of bank statements showing all the payslip deposits (plus any deposits from the new job)
- the letter from his new employer
- the original job contract from his new job
- his April 2020 P60

Has the employer been withholding tax or is he receiving his full gross salary each pay period?  Is he a shareholder in the company?  Or does he have a traditional employment contract?

He is not being paid gross, he receives his payment after tax. He is not a shareholder, just an employee. Yes, the employer is witholding tax at the moment, saying that they are awaiting some sort of confirmation from HMRC so that they can begin paying tax. All the tax the company owes in sat in an account waiting for HMRC to take. This is what my husband has been told and thats why they have not started to issue payslips as of yet.

However, this doesn't help my husband.
Yesterday the employer gave my husband a document outlining the salary he has received since he started 2 months ago, I'm not sure if that would suffice? If perhaps yourself or anyone can take a look at it I can share?
