ILR question - when to apply

Hello all.

I arrived in the UK on my spouse visa 2nd December 2016. After my last FLR-M my new BRP says it expires March 2022.

I am starting to think about taking my life in the uk test and making other preparations for the ILR but today I read you can apply within 28 days of being here for 5 years.

5 years would be December of this year! But my BRP is good for another 3 months past that …. 

So do I apply in November or can I wait until closer to BRP expiry date? I’ve looked online and in this forum and didn’t come across this.

The earliest date you can apply for ILR is 28 days before you reach 5 years in the U.K... so for you that will be 28 days before 2nd Dec 2021, which is 4th Nov 2021.

The latest date you can apply is the expiry date of your current BRP card... which is in March 2022.

So you have a window of about 4 months between 2nd Nov and Mar in which you can submit the online application.

It doesn’t matter on what date during that period you apply, so you can do it whenever is most convenient for you (once you have passed the Life in the UK test and have everything ready).
