Second FLR

Hi,

You guys helped us so much with our initial application, I wondered if you could put my mind straight about the dates of the proofs of address required ?  My husbands leave to remain expires 24-1-2022.  Also what is the earliest we should apply ?

A few questions to get some further details:

- what visa did you enter the U.K. on?

- what date did you enter the U.K. on that visa?

The date that you can apply for your next visa will depend on your answer to the above questions.

To clarify further:

- Did you enter the U.K. on a 6-month fiancé visa and then get married in the U.K. and switch to a 30-month FLR(M) visa after the wedding? In which case, you will now be applying for your second 30-month FLR(M) visa (third visa overall).

- Or did you marry before moving to the U.K. and enter on a 33-month spousal visa? In which case you will now be applying for your first 30-month FLR(M) visa (second visa overall).

Regarding proof of living together, you will need the following documents :

- 6 items of official mail in each of your names (either jointly or separately addressed) spread evenly over the last 2 years
- this means 1 item in each name dated every 4 months
- the mail must be from at least 3 different official sources (like bank statements, Utility bills, council tax bills, tenancy agreements, mortgage statements, letters from NHS, DVLA, HMRC etc.)

Thanks for the quick reply  ( I believe you helped us out last time, so thank you ). We arrived in the UK on June 1st 2019 on a 33 month spousal visa for my husband. I'm a UK citizen and we married in the US in 2001.

So would the first dated documents be Sept 2019 ?

Okay, so this is your husband's first FLR(M), not your second one.

FLR(M) visas are not quite the same as spousal visas, as they are only issued from inside the UK, are valid for a different length of time and cost a bit less.

The earliest date your husband can apply for FLR(M) is 28 days before you reach 30 months in the UK. If you arrived in the UK on 1st June 2019, then he will reach 30 months on 1st December 2021... and so the earliest date he can apply online is 28 days before that, which is 3rd November.

That means, he can submit the online application at any time between 3rd November 2021 and 24th January 2022.

You just need to make sure the online application is submitted and paid for before his BRP expires... the biometrics and visa processing can be done after that date.

No, the first dated documents will need to be dated 2 years before the date you submit the online application... so it depends when you submit it as to what months the documents need to be from.

So, if you submit in November 2021 (or even in early-mid December), then the documents will need to be from the following months:
November 2019
March 2020
July 2020
November 2020
March 2021
July 2021
November 2021

If you submit in late December (or perhaps in January 2021), then the documents will need to be from the following months:
December 2019
April 2020
August 2020
December 2020
April 2021
August 2021
December 2021

Ok, thank for the clarification, I'm so glad I asked . I hadn't realised that a  FLR(M) was different from a spousal visa. Your advice is invaluable :)) Hopefully  I don't have to ask anything else, but........

Hello again,

Now Christmas is over ( hope you all had a good one ! ) , we're ready to submit the first FLR (M) application for my husband. I have listed the proofs of address we have for the following months :

December 2019  Tenancy agreement in both names.
April 2020            Council tax bill in both names.
August 2020.       Electricity bill in both names.
December 2020  Checking account statement in both names.
April 2021.           Savings account statement in both names.
August 2021.      Checking account statement in both names.
December 2021 Credit card statement in my name
                              Letter from medical centre in husbands name.

Will these documents be sufficient ? Thank you so much for your help.

Those all look good:
- you have 7 in each name
- they're evenly-spaced every 4 months
- you have 6 different sources
