ILR questions about timing and proof of cohabitation
« on: October 26, 2022, 03:06:13 PM »
Hello most helpful people on the internet (not hyperbole, for real)!

I successfully sorted the LITUK test last week as I prep for my ILR application and despite having done most of this for FLR(m), my anxiety is keeping me up at night over the following questions. Any help is, as always, immensely appreciated.

1. My current BRP expires June 2023 BUT I arrived 28 December, 2017 (my FLR was heavily delayed during the Covid chaos of 2020 so I think that's why it's such a late expiry). Am I correct in understand that I can apply 1st of December as that's 28 days before my 5th anniversary of landing?

2. The timing for proof of cohabitation - this always catches me out. If I apply in December, do I need evidence for the following months?
Dec 2022
July 2022
Feb 2022
Sept 2021
Apr 2021
Nov 2020
June 2020

3. Just checking the financial requirements haven't changed (I don't see that I have). But you guys already confirmed my maths that we need £34,600 in cash savings for six months so is it still just a printed statement (stamped from bank) displaying proof of that and a signed/stamped letter from the bank confirming it? That's what we submitted last time.

Sorry again for being so paranoid. I'm just so so so ready to get this sorted and forget about immigration for a while!

Congratulations on passing the test!  :)

1- Yes, you can apply 28 days before the 5 year anniversary of your arrival.

2- I think the application asks for correspondence since your last grant of leave to remain. That's usually 2.5 years for ILR but sounds like it'll be shorter in your case. What you have looks good though.

3- Yes, for ILR it's 34.6k. The statements must be either originals sent to you through the post OR stamped on every page by the bank if printed from online OR accompanied by a letter from the bank stating they are authentic if printed from online.
You'll also need a statement stating the source of the savings. I believe people have been writing that as a separate letter.

That's correct, you can apply as early as 28 days before 28th December, and as late as your BRP expiry date in June 2023... so you can submit the online application whenever you're ready between those 2 dates.

Yes, that looks correct to me :). The mail should be spaced every 5 months between June 2020 and Dec 2022, and be from at least 3 different official sources.

I believe that although the application says it should cover the time since your last grant of leave, the document list may still ask for 2.5 years worth so we suggest including the full 2.5 years of correspondence.

No, the financial requirements haven't changed... for ILR, the cash savings amount needed is £34,600, held in full in your bank account(s) for at least 6 months.

And yes the document requirements are that the bank statement(s) must either be:
- official statements issued by the bank, either mailed to you or printed in branch
or
- online banking statements printed by you at home, and then either stamped by the bank on every page or accompanied by a letter from the bank confirming their authenticity (to prove you did not forge or alter them before printing).

Thank you! The test went much better than I feared (with my British partner and MIL failing miserably as I practiced ahahah).

Thank you so much for your response - makes me feel truly reassured and ready to get cracking on this!

Amazing! Thank you so much (as always). Wow, I cannot wait to get all this and citizenship sorted in the next few months.
