Application Questions - 'Children' and 'Previously Married'
« on: October 27, 2022, 12:06:04 PM »
I've just completed my first trip through the ILR application and saved it. I'm not sure about a couple of the questions which I believe did not appear in the FLR application. Would appreciate any advice!

"Children" They ask "Do you have any children whose parent is not your partner?" Does this question refer to children under 18 (we don't have any) or any children of any age (we each have one adult child from a previous marriage). Then they ask why the children do not live with you and whether they are subject to immigration control. If this application question refers to children under 18, we could both reply "No". If they mean any children including adult children we would reply "Yes". To explain why they do not live with us we would then say "I have one adult son who lives with his partner in their own home." Any thoughts on this?

"Previously Married" The past application asked both of us if we had been previously married, the previous spouse's details, and whether we could provide proof of divorce. This application only seems to ask me if I was previously married (I was). Did I miss a question where they asked my partner if he was previously married? He was, and provided similar details last time but there did not seem to be a question directed at him this time.

Thanks in advance for shedding amy light on these questions.

We had the same question regarding children. We said no children on the application but clarified in a letter that there was an adult child.

You should provide proof of divorce for both whether or not the application asks for it.

Thanks Larrabee. I too would rather answer "no" regarding children because I believe their intent is to determine if we have children under 18 living with us. Because we do not have any under 18s, I really want to answer "no". To say "yes' (as we do technically have adult children but they are fully independent) seems to point things in the wrong direction...
You say you provided more information in a letter but how do you submit such a letter?

On the "previously married" question-  we are fully prepared to provide proof of divorce for both of us but I thought it odd that they only asked me about a previous marriage, not both of us, as they did last time on the FLR application. Just thought we might have missed something...

Upload it with the rest of your evidence. Or use the "any other information" section if there is one.

I haven't seen the online form (everything was still on paper when we applied) but it's likely just to be an inconsistency. The applications are not very well designed.

You should answer No.

There is no need to mention adult children anywhere as they are only interested in dependent children under 18, particularly British citizen children… though you can mention it in a letter if you want.

They ask this question mainly because if your visa falls for refusal and they need to look to see if you qualify for the 10-year route under Article 8, they will usually only grant it if you have a UK citizen child (under 18) living in the UK, whose life would be seriously disrupted if you had to move back to your home country
