Tax Return Logistics

Hi Everyone
My wife and daughter are US citizens and I’m trying to sort out their tax affairs. They have small income from a savings account and a junior cash isa respectively but that’s everything.

How to file?

  • Is there a way to file electronically for free if you live abroad?
  • Is anyone filing by post? Where do you send your forms?

What forms do you have to compete if you’re married filing separately and have a dependent child?

  • FBAR if > 10k - is that 1 for my wife and 1 for my daughter? Is this done online?
  • Form 1040?
  • Schedule B - no need to include this right if the interest is less than $1500?
  • Schedule 8812 (Form 1040)? I’m not sure we  need to claim child credits - if you don’t owe any tax, would you get a refund from the IRS or they are only used to reduce your tax bill if any?
  • Anything else due to living aboard?

1. Filing options: https://www.irs.gov/filing/free-file-do-your-federal-taxes-for-free You may find that not all of the "Guided Tax Preparation" options support all the overseas forms - Free Fillable Forms definitely does, and this situation sounds simple enough that Free Fillable Forms should be fine. Two commonly recommended options in the overseas community are TaxAct and OLT. TaxAct is free for simple returns, not free for more complex ones (although relatively cheap compared to, for example, TurboTax). OLT is free for all federal returns (hopefully you don't need a state one).

2. You can file by post, but certainly not recommended. The IRS remains massively backed up for paper filings, easily talking 6 months for them to process the return, and hopefully they don't lose it. I've had to do a couple amendments on paper and it takes ages. But International addresses are here: https://www.irs.gov/filing/international-where-to-file-addresses-for-taxpayers-and-tax-professionals.

3. FBAR: Yes, one per person, online, completely separate from taxes. Pull all the information together on a spreadsheet, then transcribe it into their online form. First year takes a bit of time gathering information (account numbers, bank addresses, etc.), but save all that and future years should be pretty quick. https://bsaefiling.fincen.treas.gov/NoRegFBARFiler.html

4. Forms - the software should guide you through the forms you need.
  • Certainly 1040.
  • Schedule 3 and form 1116 for Foreign Tax Credit, if used. Doesn't sound like FEIE (form 2555) would apply.
  • Probably need Schedule B if you're filing FBARs because of Part III - you'd fall under the requirement to file schedule B because: "You had a financial interest in, or signature authority over, a financial account in a foreign country or you received a distribution from, or were a grantor of, or transferor to, a foreign trust. Part III of the schedule has questions about foreign accounts and trusts."
  • Schedule 8812: Only part of the child tax credit is refundable (the "additional child tax credit", but from what you've said, you'd probably get most or all of the refund, up to $1,500 per child. Have to double check how MFS with an NRA spouse affects this, I'm not particularly familiar with that situation.
  • That's it at first glance, but let the software guide you as well. I just flipped through my 2021 return and there's nothing else that would apply to your situation (mine has some self-employment stuff, capital gains, etc., but doesn't sound like any of that applies).
  • Forms 3520/3520A can apply for some foreign accounts (some argue SIPPs, for example, are foreign grantor trusts). But a savings account and an ISA wouldn't fall under this, if that's all there is.

Re child tax credit - I read online a bit more and as far as I gathered if you choose the Foreign Tax Credits route (which I think is fine in our case) you should be able to get a refund. I then filled out a test return with TurboTax but it says we are not eligible for this credit:

It gives this cryptic reason:

I wonder if it’s the MFS with NRA husband you mentioned but a lot of people here must be in the same boat? Was anyone else able to claim this?

Far more likely I’ve messed up the form but it would be nice to see it written somewhere.

I know you believe the Junior ISA to be simple.  Is it a cash ISA?  Those are simple.  Stocks and Shares ISA is the biggest error a USC can make….

Does your wife have $5 of earned income?  That’s the threshold needed for the additional tax credit refund.

I know you believe the Junior ISA to be simple.  Is it a cash ISA?  Those are simple.  Stocks and Shares ISA is the biggest error a USC can make….

Does your wife have $5 of earned income?  That’s the threshold needed for the additional tax credit refund.

Yes just a cash ISA. Everyone here seems to say that it’s a bad idea so I steered away from that. Isn’t there some sort of minimum threshold of 25k? Does that make it easier?

One of the software challenges for MFS is that nearly all ask for the spouse's SSN even though they are non- US Citizens - and this is where many come unstuck.

TaxAct is an exception that allows you to enter NRA under the spouse SSN. There is a free file version of TaxAct, it requires a few workarounds because of 2FA and non-US cell phone numbers - you can search the forum for the easiest way around this

Re: MFS filing status - If your daughter is a "qualifying person" (and you pay more than half the cost of maintaining your household) you may be eligible to file as Head of Household, which doesn't have the negatives that comes with filing married-separately.
