Question on citizenship application which confuses me
« on: February 20, 2023, 10:03:22 AM »
So, I'm filling out/in the application form on behalf of my 6 year old son, and this question comes up:

"Is this parent / legal guardian settled in the UK?"

I'm not sure what to put. As his parents, who are now both UK citizens, I initially put "No" because I assume this had to do with our legal status, which UK citizenship supersedes, but my wife thinks it just have to do if we live in the UK. I can't find any guidance on this specific question. Can anyone help? Thanks.

Question on citizenship application which confuses me

The answer is Yes - you are both settled in the UK.

‘Settled’ means that you have no immigration restrictions, so either:
- you hold UK citizenship
Or
- you hold ILR/permanent residence
Or
- you have right of abode in the UK

‘Not Settled’ means you have a time limit on your residence in the UK (i.e. a visa with an expiry date)

See the UKCISA (student immigration) site for more thorough definitions:

Thanks, good to know.

That seems like a silly question, since also in the application in multiple places it says his parents are UK citizens, the whole application isn't very smart.

Or have been granted the  UK's EUSS "Settled Status".  The UK no longer accepts the EU's PR (Permanent Residence) for the UK.

Sometimes I think it has to be deliberate!

There are many routes to apply for British citizenship and therefore different questions to be asked. Some people apply when they are already British citizens and didn't realise it and therefore get their fee returned.

I pointed out to Jimbocz that his son was born a British citizen, through his EEA citizen wife who had been working in the UK for 5 years (and therefore had obtained the EU's PR in the UK) before her son was born. Have you checked to see if your son was born a British citizen?

If he was born a British citizen, you can give all the evidence to the Passport office and apply for his passport. Just make sure that he (and his children) always keep that evidence in case questions are ever raised over whether he was born a British citizen and he needs to prove it.

Finishing up the application today and I noticed that question has been removed! Someone in charge of updating the application realised what a daft question that was in light of the other answers? :D
