residence requirements for naturalisation as a spouse
« on: May 01, 2023, 02:03:14 PM »
Hi! I'm about to apply for naturalization. My days in the last year outside the UK don't exceed the limit but in the last three years, they do exceed 270 days with just 4 days. (I had medical treatments abroad) Would 4 days cause refusal or not?

I believe I have read that they do have some discretion. Yes, I found it here.

https://www.gov.uk/government/publications/naturalisation-as-a-british-citizen-by-discretion-nationality-policy-guidance/naturalisation-as-a-british-citizen-by-discretion-accessible#:~:text=Absences%20during%20the%20qualifying%20period&text=Where%20the%20applicant%20exceeds%20the,application%20falls%20to%20be%20refused.

Is there a reason you can't just wait until you meet the requirement? It would be easier and more certain just to do that than to rely on them forgiving absences.

Have you EXCLUDED travel days?

If you left on Monday and returned on Friday, you only count Tues, Wed, and Thur which is 3 days NOT 5 days.

Hopefully that gets you inside the rules.

I'm sure that would make a big difference. I always counted those days as outside the UK.Thanks!

Really? I always thought travel days counted as days out.

Nope... they count as days inside the UK, because you were physically present in the UK for part of each of those days.

From the citizenship form guidance (https://www.gov.uk/government/publications/nationality-forms-guide/nationality-forms-guide-accessible-version#residence-requirements):

Quote
Fill in the table showing the periods you have been away from the UK during the residence period. Insert the number of days you were away from the UK in the last column ignoring the day you left and the day you arrived back in the UK.
