FLR (M) Question about time spent abroad
« on: July 06, 2023, 12:07:56 PM »
Hi there!

For context, I arrived in 2019 with the "fiance" visa, then changed it to FLR, then extended it and now next year I am supposed to get my permanent residency after being here for 5 years.

However, I have a simple question regarding time spent abroad to meet the requeriments to be able to get my permanent residency. I don't seem to find a rule set in stone for time abroad, but it seems the general consensus is no more than 180 days in the last year?

Asking because my husband and I are travelling a bit recently and we of course don't want to jeopardise all the last few years!

Am I correct to assume the above? If anyone has official links to any sort of document stating so I would very happy too so I can rest my mind :)

There is no official cut off time for the family visas.

If you are thinking of applying for citizenship as a spouse, the following apply.

Quote
.Time you’ve spent outside the UK
To be eligible, you should not have:

spent more than 270 days outside the UK during the 3 years before your application
spent more than 90 days outside the UK in the last 12 months
You may be exempt from the residency requirements if your partner works abroad either for the UK government or an organisation closely linked to government.

https://www.gov.uk/apply-citizenship-spouse

Obviously, the expectation when applying for a UK visa is that you will live in the UK but some time travelling, especially if you are together will not affect your ILR. You do still need to provide correspondence so make sure you're able to do this.

Yes, correspondence is not a problem.

And yes, we are of course living in the UK and plan on continuing doing so but we are just taking a few weeks off every couple of months to travel since our work is quite flexible. We are planning on going to central america for 6 weeks at the end of the year so this time abroad just before renewing got me quite anxious.

But it sounds like even though we are spending this time abroad, if we have everything else right in the application it shouldn't be a problem!
