Up For ILR in March—Will This Affect Us?

I’ve heard from an immigration lawyer that the new policies will go into effect in April 2024, but I can’t see anything stating this.

My current visa expires April 14 and I know one has 28 days before to apply. We are having a baby in January and definitely won’t make the £38k cut, but thankfully this is my last visa as I will be applying for ILR.

I know we may be grandfathered in anyway, but I’m just checking that this might not affect me? I mean March 14 technically ISNT spring lol.

I just don’t want to deal with the stress of a high risk pregnancy and the possibility of us getting split up.

Are you applying for indefinite leave to remain? If so, I believe you can apply up to 28 days before your 5 year anniversary in the UK. If you’re concerned about when the rules come into effect, I would apply sooner than later

Yes, ILR. I will definitely apply ASAP, I’m just wondering if it’s true the rules go into effect in April as I’ve heard or if I’m just hearing this from one immigration lawyer.

No one really knows at this stage (including the government themselves) what will actually happen.

There might not be any increase in the minimum requirement at all, it might be a much smaller increase to just £26,000 and any increase might not be applied retrospectively to people applying for extensions and ILR.

The government has specifically admitted that they do not know if any increase will be applied retrospectively, it's something that they have not yet decided on but will come to at some point.

I would say however for your specific situation, that if there is an increase to £38,700 AND it is applied retrospectively to effect ILR applications that it would be highly unlikely to effect you if you will be applying for ILR in March. The government has stated that any changes will come into place in 'Spring' 2024, and I would assume that would mean from April and on.

But we still have a very long way to go, this current government is a complete shambles and I would be extremely surprised if everything is actually in place to enact any changes by April.
