My current visa will expire in 25 August 2026. My original spouse visa was valid from 20th of July 2021. I understand it’s 28 days from that day so can I technically 23rd of June 2026. Is that right ?
We don't know yet. The present government stated last year that they are bringing in new laws for ILR in April and the automatic giving of ILR after 5 years, will end.
The default will be 10 years for ILR, but the people the UK need will get ILR in less then 10 years. Some others will have to wait longer/a lot longer, than 10 years for ILR. This based on contributing to the UK and their salary level for the previous 3 years etc. Or added years to wait for ILR for those who have needed UK public funds (welfare, housing etc), overstayed for more than x, broken the law, entered illegally, entered as a visitor etc.
They haven't yet announced how long those presently in the UK will have to wait before they can apply for ILR.
This change will also likely affect the very popular "10 years to ILR". That route often used by those who came to the UK as a Student and then looked for many ways to make the 10 years of legal stay for ILR; although the last government stopped most new international students from bringing their spouse and children with them. Since 2010, this route to ILR also used by those who came to the UK on the Tier 2 ICT (Intra-company transfer) visa with their family, because in 2010 the UK no longer allowed those on a Tier 2 ICT visa to have ILR.
This present government has also talked about a different Life in the UK test and again we don't know who or how that will affect those already in the UK.
It should all be announced soon as it is due to start in April.
