UK passport for UK born children

my husband and i are both americans; have been here 4 plus years so have ILR. We have had 2 children here, and were thinking of applying for UK passports for them in case they ever want to work in the EU.  Friends in similar situation have told us that they got their children's passports without applying for themselves. An attorney has just told me that my husband and I have to apply along with the children.  Does anyone happen to know the real truth?

Your children are not entitled to dual citizenship unless one or both of you are actually UK citizens.

What sort of information did your "friends in similar circumstances" give in order to obtain British passports for their American-parented children?

The parent has to be a UK citizen OR settled here, by which I imagine is meant that they have indefinite leave to remain here and a permanent home here. Show this to your solicitor:

Section 1(1) British Nationality Act 1981

3.2.2 Under s.1(1), a person born in the United Kingdom on or after 1 January 1983 is a British citizen at birth if, at the time of the birth:

    * either parent is a British citizen; or


    * either parent is settled in the United Kingdom

thanks, britwife.  i think the catch with us may be that our children were born before we got ILR :(
