Over-stayer applying for a spouse visa, heeeelp!

"Sorry, sponsorship by persons other than the UK-resident spouse is not acceptable.  To qualify for the granting of a settlement visa, the Immigration Rules require that the couple must demonstrate an ability to maintain themselves (and any dependants) adequately from their own resources and without recourse to public funds.

Jasmin, a challenge to this rule was brought to the Tribunal and ultimately went to the High Court and they decided in favor of the appellant.     Accordingly, while the rule is still on the books technically; it's been substantially mollified in practice.

It seems that the NY consulate is more lenient then any other. A lot of people have had their visas granted even though they did not always meet the requirements. I'm worried that the Chicago office may not be so generous. I was just wondering would it be a better idea if my husband transfered the savings from my mother-in-laws account to his current account? Or does it not matter? How is income support similar to JSA? I thought that to claim Income support you have to be on a low income but an income nonetheless. JSA, well you aren't earning anything

I get income support because as a single mother i am deemed unable to look for work  as i am the sole caretaker of my son.  If i didnt have a child then i would be on JSA as i would be able to seek work. As far as i know the ammount you get paid is the same, it's just paid for by different departments.
Income support is for people with no income at all.

when i put savings into an account in my name 2 days before going to NY i also got a letter from my mother saying i was left this money by my grandmother who died a few years back and that she had invested it with her money so that i would get a higher rate of return. The consulate didnt ask about the lack of statements for that account, so didnt see my mothers statement,  but im sure that i read somewhere that they wanted to see statements....im not sure though. That was just my experiance. Hope that helps.
