ILR from the US?
« on: July 12, 2005, 06:36:18 PM »
Has anyone here applied for ILR from the US (under the "married for over 4 years" provision)?  If so, how long did it take?  Also, the SET(M) application asks about dependent children but I confess it seems to me that they are asking about children from previous marriages and not our children.  Do I need separate visas for the kids, or can I put them on the SET(M)?

Stephen's job wants him to start end of September/early October.  We do have a little leeway in that, but we'd rather not delay much longer.  So we're trying to decide if it's worth it to mail the form in or if we should just plan on making a trip to NY.

Thanks to anyone with any advice!

It is fast-tracked like the rest of the family creation visas, so there's really no reason you can't get it all done in a day.  As to the SET(M) and kids, it's only the children [1] who are coming with you; and [2] do not have ROA or citizenship in their own right...

I'll be interested in knowing how it goes for you Saf as I will be eligible for the ILR when we do our application.

Yes, but I'd rather not, as that means a trip to New York which is A)Out of our way, as I am in South Florida, and B)expensive and takes more time.  I'd rather just be able to mail it but I'm worried it might take too long.  Any idea how long it would take in the mail?
Thanks for the info re kids tho.  So I would just add them on the SET(M) and there you go?  Excellent.

My fiancee visa by post took 8 days from when I mailed it---- I would assume it would be about the same time frame.

I believe when you apply for the ILR here in the UK it takes longer than 8 days, I'm afraid. A friend of mine did hers a few months ago by post and got it back in 4 weeks, but they say on the Set (M) form that it can take up to 90 days. We couldn't risk it and went to Croydon and paid the £500 premium fee to get it same day since we were planning on being in NY for early Sept for a wedding.

When you apply from the US do you send it the same address everyone here in the UK does?

No, when you apply in the US you are sending to a US address.
