Question about US student loans
« on: September 25, 2005, 11:29:57 PM »
I dont know if I am under the correct category for this question, but I thought I would throw it out there and see if anyone has an answer.

I have meen married to my British husband for two years in November and I still have not changed my name on my passport (I have also been assuming that is the only way in which i have to legally change my name). There are two reasons that i have not changed my name, not in an order, but  1) i am torn with my feminist side and want to keep my maiden name and 2) i have outstanding US student loans that I have deferred for the time being and I am worried that if I change to my husbands name they will affect his credit rating in some way.  So my questions are, has anyone dealt with a student loan situation while living abroad and will my loans affect my husbands credit rating in the UK?

This also leads me to another question, will I need to have my name changed when I apply to stay in the UK permanently after the spousal visa expires?

I know this is more than the one question promised, but if anyone has any insight, i would appreciate hearing it.
Thanks ;D

I have a student loan that I just left in the states and that was in 1997......I have taken my husbands name and it hasn't affected our credit in anyway.........

We have more than ample credit.......

I would think for legal and immigration reasons it would be a good thing to change your name to your married name......

We have just filed US income tax for me for the last 5 yrs......I am sure they will now catch up with me regarding my student loan.........we have also just filed I-130 papers as well which is why I filed the income tax........

you are suppose to file income tax regardless if you are in the USA or not.....you still have to declare any earnings as you are a USA citizen....you are allowed I think up to $80,000 before you have to start paying any taxes but yes you have to file............i know alot of ppl don't bother........but as we haved filed the I-130 which is the start to repatriate, we want to move back to the USA.....

We read somewhere that they ask for income tax filings for several years and have read that ppl not knowing they were suppose to be filing income tax we denied for trying to get spouse visa's and green cards......

That is interesting info, thanks for sharing it ;D  It makes me wonder though, would i have to file taxes on my british husbands taxes even though I am not working?  are you worried about your student loans? have they been deferred?

No you don't have to file taxes on your British husband..I filed married but filing seperately.

If you haven't been working file a nil form in...

Student loans.......haven't thought about it....I never contacted them. I had to much else to worry about then that.
I am sure it will catch up to me tho.

same form but show nil (0) that you haven't earned any money........fill it out with all your info in it and put 0 on the lines lines, cause you haven't worked and not earned any money or you can put N/A ( not appliciable), copy them and then send them to the IRS office at the London embassy....

you can print the forms off of the IRS website.

..it is just like the US you still have to file regardless, but show them you haven't earned any money, or in my case I did but less than $80,000

I didn't ever bother with it.........the main reason I have filed now is the immigration reason. Alot of Americans I have talked to don't ever bother as well...it's up to you.
