Passport question

My friend's boyfriend who is American is trying to get a new passport in Florida (he has lost his previous one) but was told by the courthouse when he went to apply for it that, because he was arrested for burglary he wouldn't be able to get a passport. He was arrested for it 14yrs ago and spent 9 days in jail but was never charged as they apparently found the person responsible so he was released. Mind you I can't understand why it is on his record if he was released and never charged but my question is..does anyone know if this would stop you getting a passport? Even if he did do it would it stop him getting a passport?
Any help would be great....thanks!!
