I am a US citizen living in Ireland with my partner who is Scottish but working in Ireland.  I have been here for going on 3 years now, having to register with the garda each year.  When I moved here I sold my quit my job in the states and sold my house since I saw no reason to keep that if I was planning on taking up residence in Ireland.   I am divorced and my partner has been separated for 5 years.  He hasnt gone through the divorce yet.  My question is ,  his company might be sending him to the UK to work in another year or so.  Can I legally move there as an UP since Im divorced even though hes not yet?  Ive read on other sites that it says you can apply for this as long as  'any previous marriage has permanetly broken down'.   I dont know if this means divorced or if being separated for so many years would apply? I want to apply for dual citizenship but I cant apply for citizenship here in Ireland yet for another 2 years.  Can anyone please help me on this?  thanks  :)

The Unmarried Partners programme covers partners who are still married, but unable to obtain divorce for legal, political, or religious reasons.  If your partner can establish one of those grounds *and* simultaneously clear paragraph 278, then he's ok.

Yes, the rules.  They should be on the IND site, I went to check, but it appears to be down at the moment.  If there's a Borders near you, you can get a good interpretation of paragraph 278, adjudicator decisions and what-not,  in Butterworths.
