Leave to Enter question
« on: December 15, 2005, 04:53:56 PM »
Okay.  Say a US-UK couple gets married, and the American is living in the UK on FLR or a spouse visa. They move to the US before the 2 years is up, so the American never applies for ILR.  Three years later, they'd like to move back to the UK (at this point having been married for say 4.5 years.)  Does the American get Indefinite Leave to Enter based on having been married more than four years?

Yes, that's fine.  Use the VAF2 form to get the ILE concession, and then enter the UK under paragraph 18.  No problem.

Just wasn't sure whether the four years of marriage had to be solely outside the UK or not :)  Thanks for the info.

Incidentally, Rose, this is what I did, and I had my ILE in a week with no problems-except they did ask me to get a new passport, because mine expired next year and I would just have had to get a new stamp then anyway.
