Time out of the UK with an FLR

I have FLR, as do my boys.  We received our FLR visa's in Sept. 2004, I have been out of the UK in total 2.5 months and will be once again returning to the US for another 3 to 4 months.  How will this time away hinder our ILR process?  Is there a way to extend the FLR until the time in the country is adequate?

I also have a son who was born in the US with my DH, a UK citizen, I was required to get him a Visa.  Was this correct?

Sorry- I can't help with the FLR out of country question.  However, I do know that when going for your naturalization you can't be out of the country more than 450 days in total, and no more than 100 days out from the last 12 months.  On the form you have to list all the times you been in and out of the country- i'm out of the UK 15+ times a year so i've started keeping a detailed list, even though I'm 2 1/2 years away from going for naturalization.

Have you had a look through the SETO(M) form which I'm assuming you'll use to get your ILR?  It may answer your questions.

I know Maddie can answer these questions herself, but she's not online right now and I know she wants to get this sorted ASAP.

Her second son was born in the US, of a marriage to a British spouse.  She already had FLR when the child was born and was only temporarily out of the UK.  Before coming back to the UK, some bright spark in one of the UK Embassies told her that this child needed a visa to enter the UK.  Consequently, the child, who has the right to British citizenship, is currently in this country on FLR.  I think she needs to know how to go about getting him off FLR and registered as a British citizen, which is what the embassy should have told her to do in the first place.

If you don't think that the time you and your son have spent in the UK is sufficient to be given ILR, then yes, you can simply make another application for further leave to remain as a spouse.

How old is your son? If your UK national husband is his father, once he is settled in the UK you may be able to apply for british citizenship for him.
