Visiting UK, can I remain here with UK spouse?

My UK spouse and I (USA) have been married 5 years and living in the states - he is still a citizen of UK and holds his British passport. Is it possible for me to stay in the UK if we decide to whilst visiting there and sort me out a Settlement Visa? Id be coming on a Visa Waiver.

You are automatically entitled - because you have been married four years - to ILR (indefinite leave to remain).  However, no, you can't do that after you've gotten here.  You need to apply for it before you've left the States.  In other words, no.  You can't just stay without having obtained ILR before leaving the States.

oh alrighty then - the embassy here called it a settlement visa tho..im confused

It is a visa which leads to settlement.  Settlement and indefinite leave are the same thing.

You would apply for Indefinite Leave to Enter the UK at the Embassy before you come=over, but as has been stated you can't apply from within the UK.

thanks soooo much.
we will stay with his auntie who has her own home in East Sussex while hub looks fora job ... i looked at the "American chicks guide to moving to the UK" but its very outdated (2002), can someone tell me what i need to send into the British Embassy with my application thats done what we want to do?   ???
