might delay because of refusal?
« on: March 07, 2006, 08:03:30 PM »
Its me again...the consulate emailed me after I asked them a question and told me because of my refusal of the previous visa my application may not be straightforward and therefore processed on the same day.

Anyone else had a visa refusal and gone on for fiance/e visa, and if so what happened to you? Was there an extra wait? Why would there need to be an extra wait if they denied because I was told I would try to settle, and now I am?

Not on a fiancee visa but my FLR was refused the first time and I was issued my entry clearance the same day at the LA Consulate.  It took until almost 3:30pm though, when everyone else had their passports returned at 2pm.  It was an anxious hour and a half.  I gave them the refusal letter from the HO and they told me they had to talk to London before they could issue it.  They did tell me that it could be issued the next day but I ended up getting it, just later than usual.
All you can do is go, be honest about everything, bring every scrap of paper about your refusal and other items for your visa.  It's nerve wracking but there's nothing you can do except be prepared and honest.

The setting sun is reflected from the windows of the almshouse as brightly as from the rich man’s abode; the snow melts before its doors as early in the spring. Cultivate property like a garden herb, like sage. Do not trouble yourself much to get new things, whether clothes or friends. Turn the old; return to them. Things do not change; we change. Sell your clothes and keep your thoughts…

Im going in early so hopefully that will help, I know they will have to get details of my refused entry...the visa was through the same consulate but I will bring whatever I have with me.

Is it a good idea to go through emails and add a couple to the package? I dont have any from before december though :( Unless I have some on the other comp at home...gonna have to get  a jump drive just in case.

I don't think going early will matter.  In LA, they won't let you up onto the 12th floor until it's time for your appointment and even then, you sit there until they call you.  Just be on time and prepared.

Best of luck to you Aeonix - let us know how it turns out!

Aeonix,

I applied for a spousal visa in Chicago last year and this happened to me. I was expecting to walk away with it that afternoon. I had sent in my electronic copy of my application like they had asked. I assumed they'd be taking a look at it before I got there and would see that I had been denied entry once and would have gotten that information from the aiport immigration. But they didn't. I showed up and she saw that I had been denied entry once when she looked at my passport. Then she told me that I couldn't get it issued that day because they would have to phone the aiport where I was denied to have them fax over their records.

Now, what's the point in sending in an electronic copy of your application before you get there if they aren't even going to look at it and be prepared for you when you get there? I don't know.

Anyway, I was fortunate enough to have my information at the Newcastle airport which is quite small. They managed to get it the next day and I got my visa. She told me though that had it been at Heathrow it could have been more like a week.

I was denied at Gatwick :(  I agree with you...guess I will just have to wait it out if need be. Did they overnight your passport back once you got the visa or did you pick it up in person?  Picking it up wont be an option for me, so if I dont get it tomorrow hopefully they would at least get it to me asap.

Your appointment is tomorrow?!?  I didn't realize it was so soon.  Good luck - it seems that some people here have had success under similar circumstances.  Hopefully you will too.

I think actually going there in person is a lot better than this whole mailing thing. If I lived closer to NY I would have made an appt. I think seeing you face to face and asking/answering questions will get you through the process quicker.

I agree...but only if you've never been denied entry. The whole point of going in person and paying more (in my opinion) is to get it all over with in one day and cut down on the waiting time.

If you've been denied entry, it isn't that much quicker. I was lucky. I had been denied at Heathrow but flew into Newcastle a couple months later where I was let in. Because of that, they were able to get the records from Newcastle and it's a very small airport. Even then, the woman handling my case told me I was very lucky I got it the next day. She figured it was going to be at least 3 days.

I actually stayed in Chicago one more night and took the chance that I might get it the next day. She told me I was really lucky that I did.

I would think you could make arrangements to get it overnighted to you if that's not standard.

Good luck!

I suppose going from Chicago even if they wouldnt overnite it it would be relatively quick to arrive, but the mail around here is notorious for its bad service :(

Unfortunately theres no way I could stay in the city, would be nice just in case but theres a lot of reasons I cant...just gonna have to stick it out, I dont really have much other choice do I? :(

Im beginning to think I definitely need luck, thank you :)

If they send it overnight, it will come FedEx, not USPS.
