Cohabitation prior to marriage?
« on: April 03, 2006, 03:24:09 PM »
My husband has been in the US since June 2002, when we were married.  We've lived together since then.  But we also lived together for a year from 2000-2001.

Should I include evidence (old lease) of this in our spousal visa application?

Or is it overridden by the fact that we've lived together since marriage?

Thanks.

If you married in 2002, then be sure not to apply until after your 4th anniversary in 2006 so that you can qualify for the ILE concession.  Also it saves 365 pounds, plus avoids stress about the leveling down that's almost sure to happen…

Thanks for the tip - I hadn't even thought about the money it would save.  That is actually our plan (to wait until after the 4th anniversary to apply), but my husband is heading back next Monday so I wanted to make sure we had all our ducks in a row before he left.  That way he'll know exactly what paperwork he needs to be collecting over the next few months.

I've been reseacrhing this and there is a good chance that if you apply now they will take the time spent cohabiting into the four years, as it would be unfair of them to treat you differently from unmarried partners just because you got married.

However, there doesn't seem to be any guarantees on this one, so waiting until after the four years of marriage is probably more certain of success.

Nice!

Even tho' there's no guarantees on it, I would like to put that question to the Entry Clearance Users Group.  May I?

Do it.  It's discussed in the new JCWI handbook.

TA!  If the ECUG come up with a good answer, then Carrie's good to go!
