I have a serious immigration issue, please help me.
« on: May 10, 2006, 11:30:57 PM »
Hi there.  I'm a newbie.  I was directed here from the immigration LJ community.

I am currently on a further leave to remain 2-year visa (marriage).  It expires in exactly 10 days.

I only realised this TONIGHT when flipping through my passport.  Stupid, I know.

I'm really terrified now.  Money is a major issue.

We are planning to move back to the states, but not for roughly 5-6 months.  I don't really have the desire to get IDL.

What happens if I allow my visa to lapse?  Can I get an extension of a few months on this visa?  What are my options?  I did try Immigration Advisory service, but the website isn't much help for my situation and their phone number isn't open for another week yet.

Any help you can provide will be very, very appreciated.

Fill out an FLR(O) form and include an explanation of why you need an additional 5 - 6 months leave.  It is not totally rare that people wind up in this situation, and it will probably take them that long to process your applicaton anyway  ;D

Can't help with the money.  The app costs £335 and there's no waiver of fee for that one...

Thank you!  Am I right in thinking that £330 is the same price as the Indefinite Leave to Remain visa?

If so, would it be any easier/harder just to apply for that?  That way, we could come back here more easily should we need to?

Also, could you please explain the consequences of letting my visa lapse and waiting a few months to leave?  We are going to have serious trouble finding the money, so there's a possibility we could miss the deadline.  Do we get any grace period to apply for extension?

Thank you so much!

The consequences of overstaying are receiving an administrative removal on your way out.  It's not the right era to be lax about compliance with immigration rules.

The ILR application is the same price as the FLR, so you may as well go for that IMO.

I second what garry has said....just overstaying your visa is not an option...not if you ever want to come back again.

And next year, that would include the whole EU
