Name Confusion
« on: May 30, 2006, 04:31:49 PM »
Since I'm changing my name in a few weeks, I'll need to get a new passport.  Problem is, when I get married, I have to send in my passport with my old name on it to get a new work permit and visa...the new stuff will have my new name on it.

It's only 18 days til I'm married, and I can't send out for a new passport with a new name because I have no identification with my new name on it.

What do I do?

If you understand this, please let me know what you think.  Thank you.

Do you *have* to change your passport and visa?

This could all get rather expensive for you...

Well my passport has to be changed because it will no longer have my legal name on it, and if I want to continue to live with my husband in the UK and to work, I will need to change my visa as well.

How are you able to travel with a different name?

Are you switching from a work permit to a spousal visa?

What ever name is listed on your passport is what you travel on........there are loads of woman that keep the maiden or previous name on their passport.....you just have to make sure that your airline ticket or what ever kind of ticket you are travelling on is in the name of your passport....

MeShell - She's mentioned work permits, so it may be that she has to change her documentation anyway, and wants to do it all.  Although, if American, I doubt that a new passport can be issued in 18 days.

No, I'm on a spousal visa now, but the 6 months is up soon and I am getting a new 2yr visa which includes a work permit.

Okay...you confused me because you are using the wrong terminology and have your facts wrong so I am afraid i didn't quite get what you were talking about.

It now sounds as though you were on a fiancee visa, (rather than a spousal visa) and are about to marry.  You then need to switch to a spousal visa, which comes with the right to work (NOT a 'work permit', which is something entirely different).

Anyway, you won't be able to change your passport in 18 days, so forget that.  You are going to have to do as MeShell quite rightly says, and just travel under your maiden name.  Even if you put your married name on the FLR (M) the visa will be issued under the name on the passport.

And they will let you travel on that, even if you use your married name in every other walk of life. Just because you marry, you don't 'lose' your previous surname.

Oh I see.  Sorry about the terminology...I'm not very good with legal terms.

So, my new spousal visa will be under my maiden name?  What will that do for me when I need to work or need to use it for some other identification purpose other than travel?

Sorry, I'm not trying to be difficult, I just find all this legal jump quite frustratingly confusing.

It won't make the blindest bit of difference really.  If you have problems, you have your marriage certificate will show the name change.

You can always double barrell if you are worried!

After we got married, I returned to the States, changed my maiden name to married name on US drivers license and in my passport. Then I applied for my spousal visa in my married name. So I have my old passport with my maiden name, but on the last page they (US Passport Office) put a note in it to indicate that my name was officially changed on such and such a date.
