Topic: Would American husband be able to apply as a spouse to a EU resident?  (Read 1318 times)

I'm a Swedish citizen and am wondering if my American husband would qualify as a "spouse of a British resident" in applying for a visa. If this is possible witout having to be a British citizen, would I first have to live in the UK for some time to establish residency or is British residency automatic upon arriving for any EU citizen?
Anyone's been in the same situation?

If you are an EU citizen, you first establish your residency as an EEA national with the Home Office and then your husband applies as the spouse of an EEA national for his residency, which will usually be a period of 7 years, and as long as you have your residency in order, he can renew it when his expires.

What does EEA stand for?
Also, is anything required of me to establish residency with the Home Office, such as financial security, employment in the UK, a UK address etc?
Also, once I have my residency and I apply for my husband, is there anything I have to prove? Here in the States, my husband had to prove his income was above poverty level--pretty easy. I'm guessing that my husband would not have to have secured employment before applying for residency, but could take up jobhunting upon arrival, is that right?

Lots of questions..;).

It's been awhile since I went through the process, and things could have changed - your best bet is to go to the Home Office website and look up their requirements:

What does EEA stand for?

European Economic Area, which is a confusion treaty that is similiar to the European Union, but is slightly different.  http://en.wikipedia.org/wiki/European_Economic_Area

And as a the spouse of an EEA citizen living in the UK, your American husband would have more job opportunities than someone like me, who is an American citizen married to a British citizen.

Yes, in a sad twist of fate, an Non-EEA Spouse of an EEA Citizen exercising their treaty rights can apply for public sector jobs, which a non-British non-EEA spouse of a British citizen cannot.  Don't you just love immigration law?

If you are outside of the UK your husband can apply to enter the UK as the spouse of an EEA national, and you don't have to go near the Home Office. You do everything through the consulate, and the process is almost the same as if you were a UK national..just a bit easier and free of charge!  YOu don't need to prove residency first, you just need to show that you intend to come over with him and work/study.
