Easiest way to go back to USA
« on: July 09, 2006, 11:07:55 AM »
I am marrying an american citizen in USA this October, she will get a spouse visa and we will both come back to UK for a few years , after which we plan to both live in the USA.

Anyone know the easiest way for me to get a visa ? I dont see my wife can sponsor me as she will have no job or residence in the USA.

Thanks

We're thinking of doing the same thing...but I plan not to think about it until we're settled in the UK and know what we want to do lol.

Stay in the UK long enough to do Direct Consular Filing (USC has to meet the residency requirement, which I believe is two years)-gets you your green card before you even leave the UK.  No mucking about with K-3 visas, which can take ages!

Technically, you won't get the green card until after you have arrived in the US on your visa.

No, but you do get a stamped MRIV (machine readable immigrant visa) in the interim, which grants permanent resident status-and you don't have to do anything more than wait for your green card in the mail (as opposed to K-3, which splits the process into two parts-part one is getting the K-3 issued in the UK,part 2 is getting the green card issued in the US).

sorry if I seem a bit thick, but did I read this correctly? Not that we ever intend to live in america again, but im american, dh is british, we live in britain, and next may will be 2 years living here, so after that if we wanted I could just apply for some new thing for him to just get his green card, and in theory we could just move back to america no hassle?  can you automatically work again in the states on a green card?
thanks

I thought it sometimes took years to get a green card? DH and I are thinking of doing this in the next few years as well (after I have my british citizenship).

joni, the good thing about DCF is that it takes months off the waiting time for a visa.  And yes, after you have the green card there's no hassle, especially since you won't have to deal with the conditional green card stuff at all (since you will have been married for over two years when you move back.)  He'll have permanent resident status upon entry, which means he can get a SSN and then apply for jobs right away.  This is what my family experienced when we moved to the US from the Caribbean, although it was my dad being sponsored by his naturalized US citizen dad and not by a spouse.  As far as US immigration options go, DCF is probably one of the easiest and most straightforward.

For a US-UK husband/wife couple, the waiting time (especially through DCF) is measured in months, not years.

It only takes years if the sponsor's relationship to the non-US citizen is other than marriage (ie sibling, or parent if the non-US citizen is an adult child.  It took 2 years for my dad, his wife, and kids to be granted green cards after we were sponsored by my grandfather in the early 90's.)  Also, the wait time for those from third world (especially Middle Eastern) countries are usually much longer than applications from more developed countries like the UK. Sad, but true.

chris already has a social security number because when we lived in the states he got one then. we have been married since nov 2003, so technically we have been married for over the 2 year requirement. does this speed anything up or no?

Thanks for posting this question, this is exactly what my husband and i want to do, we plan on him staying here for 4 years then myself (UKC) my husband(USC)and my 2 children from a previous relation want to pack up and move back to the states.

Does anyone have any links to information on DFC. I found something the other day but it was so hard for me to understand.

Nothing like having the knowledge to hand.

Check the "Helpful Sites, Information, and Cover Letters" topic at the top of this forum.
Also, I posted my DCF story as well, in the "Comprehensive Timeline" thread. We did this 2 eyars ago and a few of the small details have changed I'm sure (they do frequently!) but the basics are still the same. If you go to the Embassy's site (listed in the Helpful Sites) they will have the most up to date rules that you can use in conjunction with that timeline.
I'm done moving. Unrepatriated back to the UK, here for good!

Ok, what happens if we apply for my Brit husband's green card through DCF (we've been married 8 years in March) & we get it (or rather the stamp-thingie) but don't move to the US? Does it stay "open" for an indefinite period so we can move at some point over the next few years? Or is it open for, say, just 12 months?
