Thank God for this site - that's all I gotta say!
I have a somewhat unique situation. I live in Florida, my fiance lives in the UK at the moment. I have a 3-year-old son from a previous marriage. We want to settle in the UK, and I'm wondering what the easiest way to do this is. My ex-husband will sign over custody, that's not a problem, but do I need seperate visas for both of us? What visa do I need for him if I get a fiancee visa in the UK? Is the best route to take having my fiance come here to get married, then apply for a spouse visa? Lots of questions - any info would be great!!

Actually everything in your case sounds pretty straight forward.

There is a thread currently going on that is talking about the benefits and costs of getting married in the UK versus the US: http://talk.uk-yankee.com/index.php?topic=25972.0  Both options are open to you.  There are a lot of considerations including fees and costs and there is no clear cut answer.

Your son would need a VAF2 Settlement Visa and come over as a dependant child of you.  You would apply for this at the same time you apply for your VAF2.  A great place to start is: http://www.ukvisas.gov.uk/ and will lead you to all the right forms.  You will need a formal legal document stating that it is ok with your former husband that you relocate to the UK.  You will also have to provide legal proof that you are divorced.
WARNING My thoughts and comments are entirely my own.  Especially when it comes to immigration and tax advice, I am not a professional.  My advice is to seek out professional advice.  Your mileage may vary!
