Topic: Does a British citizen need job for US wife and kids to move to UK?  (Read 982 times)

Hubby is thinking very hard about moving back. He has been here since 1996 and wants to know if he needs to have a job before me and the kids file for our visas to move there. Any info would be great. He moved to the states with being married to me in 1995. He has his permanent residents card.

I believe he only needs to prove he can support you, or rather you need to prove he can support you and the kids and that you will be able to contribute to that (if thats the case). But of course a job would help to prove that. Is there anyway you could get a family member in the UK to co-sponsor you? That helps prove your husband will be able to support you and the dependents until he (and yourself if thats possible) find employment. The Co-sponsor would just have to write a letter and submit bank statements and/or wage slips as proof of financial stability.

I thought that I couldn't work for two years after arriving in the UK? Am I wrong? As I do not know how I could support myself and the kids if I was not allowed to work legally.

If you get a spousal visa, then you are allowed to work for up to 2 years in the UK...then you have to apply again to remain permentantly in the UK and work etc.

Unless you've been married for over four years like the OP has....so Munchie, if/when you apply for a spouse visa, you'll actually get Indefinite Leave to Enter (ILE)...same as ILR but a different name.  So you'd be a permanent resident upon arrival, with rights to work, claim benefits, etc already in place with no expiration date on your length of stay.
Now a triple citizen!

Student visa 9/06-->Int'l Grad Scheme 1/08-->FLR(M) 7/08-->ILR 6/10-->British citizenship 12/12

Will the kids have to apply at a later date before 18? What do they do when they become an adult? Will they need to apply for any type of visa to stay in the UK as an adult but living in the UK since childhood? What if they want to move back to the US?

assuming your DH is the father of your kids, then they should qualify for dual US/UK citizenship (in fact, if your DH was born in the UK, they absolutely do qualify.)  So you should be able to get them both a UK and US passport without any worries, which means they can live in either country without any immigration issues and move back and forth with no hassle whatsoever.

As the kids have "dual" will they need to file for visas? Or can they just move over on the passports?

no visas necessary, just their UK passports. you're the only one who will need a visa.

Thats great news. Now another question, can we get the UK passports here in the states via post from the UK embassy here in the states? Or do we have to actually go to the UK embassy?
