Topic: Daughter denied work dependent visa..can she just come and stay as visitor??  (Read 2548 times)

Sooooooooooooooooooooooo....
I guess my questions now are these:

What do I do now?
Be British and patiently wait?
Apply for a prospective student visa and hope this one goes through?
Or do I try for an appeal first?

I don't mean to be pushy or seem needy..but maybe in this circumstance I am.

The thought of leaving the country in two weeks and leaving the kid behind with all of this still up in the air is not a pleasant thought for this mama.

What do I do next please????

Your best bet is to send a PM (Personal Message) to VictoriaS.  She is a immigration specialist who is very knowledgeable and would be able to advise you on how to appeal the decision to get your daughter in the UK.  To send her a Personal Message, click on her name in one of the forum posts.

Victoria was saying that you very likely have grounds to appeal.  It might take a little while, meaning that she would probably stay in the states for a period of time, but an appeal might take several months.  Victoria can advise you a lot better on a personal basis.

And during the time her appeal is processed, she'll need an entry clearance to come even as a family visitor.

But for an appeal, Victoria's fine.  I make referrals to her all the time. 

It's good this happened now because by the end of next year, work permits will be issued only by foreign missions, that change was sneaked through last Feb when nobody was looking and was one of the things that prompted me to take up advocacy.

But to the larger issue:  unless the advocacy side can gain a significant advance in the next 16 months, the chance to appeal T2 and T3 refusals will be gone *forever*.  And from there, it's a short hop to implementing the same provisions in the family programme and dependents will be the first to go. 

The white papers are already circulating in Milbank, and at least one so far has been sneaked.
